    APPLICATIONS RECEIVED UNDER THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT

    [National Pollution Discharge Elimination System Program (NPDES)]

    (Part I Permits)

       The following parties have applied for an NPDES permit to discharge controlled wastewaters into the surface waters of this Commonwealth. Unless otherwise indicated on the basis of preliminary review and application of lawful standards and regulations, the Department of Environmental Protection (Department) proposes to issue a permit to discharge, subject to certain effluent limitations and special conditions. These proposed determinations are tentative.

       Where indicated, the EPA, Region III, Regional Administrator has waived his right to review or object to this proposed permit action under the waiver provision 40 CFR 123.6E.

       Persons wishing to comment on the proposed permit are invited to submit a statement to the Field Office indicated as the office responsible, within 30 days from the date of this public notice. Comments received within this 30-day period will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Field Office the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held if the Field Office considers the public response significant.

       Following the 30-day comment period, the Water Management Program Managers will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.

       The application, and related documents, proposed effluent limitations and special conditions received and other information are on file and may by inspected and arrangements made for copying at the Field Office that has been indicated above the application.


    Applications for National Pollutant Discharge Elimination System (NPDES) Permit to discharge to State waters.

       The receiving stream is classified for warm water fishes, recreation, water supply and aquatic life. For the purpose of evaluating effluent requirements for TDS, NO2-NO3, fluoride and phenolics, the existing downstream potable water supply intake considered during the evaluation was Pennsylvania American Water Company located in Silver Spring Township, Cumberland County. The discharge is not expected to impact any potable water supply.

       The receiving stream is classified for trout stocking fishery, recreation, water supply and aquatic life. For the purpose of evaluating effluent requirements for TDS, NO2-NO3, fluoride and phenolics, the existing downstream potable water supply intake considered during the evaluation was the Columbia Water Company located in Columbia Borough, Lancaster County. The discharge is not expected to impact any potable water supply.

       This application is for issuance of an NPDES permit to discharge untreated cooling water and stormwater from the Harrison City Combustion Turbine Project Unit 6 and Unit 7 in Penn Township, Westmoreland County.

       The following effluent limitations are proposed for discharge to the receiving waters, Unnamed Tributary to Busby Run, classified as a trout stocked fishery with existing and/or potential uses for aquatic life, water supply and recreation. The first existing/proposed downstream potable water supply (PWS) is Pennsylvania American Water Company, located at 410 Cook Lane, Pittsburgh, PA 15234 (Monongahela River-Becks), 27 miles below the discharge point.

       Due to the significant public interest in this project, the Department of Environmental Protection (Department) is holding a public meeting on December 6, 2000 at 7 p.m. at the Harrison City Room, 1010 Mill Street, Harrison City, PA 15636. The purpose of the hearing is to present an overview of the wastewater sources, quantities, quality and proposed effluent limitations and accept oral and written testimony from any interested party on the provisions contained in the Draft NPDES permit. The proposed wastewater discharges from the facility will go to an unnamed tributary of Bushy Run which is classified as a trout stocked fishery.        The following effluent limitations are proposed for discharge to the receiving waters, known as Chartiers Creek, which are classified as a warm water fishery with existing and/or potential uses for aquatic life, water supply and recreation. The first downstream potable water supply intake from this facility is the West View Municipal Authority located on the Ohio River.

    Proposed NPDES Permit Renewal Actions for Minor Sewage Discharges

       The following parties have applied to renew their current NPDES permits to allow the continued discharge of controlled wastewater into the surface waters of this Commonwealth. The Department of Environmental Protection (Department) has made a tentative determination to renew these permits and proposes to issue them, subject to their current permit effluent limitations, and monitoring and reporting requirements, with appropriate and necessary updated requirements to reflect new or changed regulations and other requirements. The updates may include, but will not be limited to, applicable permit conditions and/or requirements addressing combined sewer overflows (CSOs), municipal sewage sludge management, and total residual chlorine control (TRC). Any major changes to or deviations from the terms of the existing permit will be documented and published with the final Department actions.

       The EPA, Region III, Regional Administrator has waived the right to review or object to these proposed permit actions under the waiver provision 40 CFR 123.6E.

       Persons wishing to comment on the proposed permits are invited to submit a statement to the Field Operations indicated as the office responsible, within 30 days from the date of this pubic notice. Comments received within this 30-day period will be considered in the formulation of the final determinations regarding these applications and proposed permit actions. A public hearing may be held if the Field Office considers the public response significant.

    Applications under the Pennsylvania Clean Streams Law

    (Part II Permits)

       The following permit applications and requests for plan approval have been received by the Department of Environmental Protection (Department).

       Persons objecting on the grounds of public or private interest to the approval of an application or submitted plan may file a written protest with the Department at the address indicated above each permit application or plan. Each written protest should contain the name, address and telephone number of the protester, identification of the plan or application to which the protest is addressed and a concise statement or protest in sufficient detail to inform the Department of the exact basis of the protest and the relevant facts upon which it is based. The Department may conduct a fact-finding hearing or an informal conference in response to any given protest or protests. Each protestor will be notified in writing of the time and place of any scheduled hearing or conference concerning the plan or action or application to which the protest relates. To insure consideration by the Department prior to final action on permit application and proposed plans, initial protests and additions or amendments to protests already filed should be filed within 15 calendar days from the date of this issue of the Pennsylvania Bulletin. A copy of each permit application and proposed plan is on file in the office indicated and is open to public inspection.

       The following parties have applied for an NPDES permit to discharge stormwater from a proposed construction activity into the surface waters of this Commonwealth. Unless otherwise indicated, on the basis of preliminary review and application of lawful standards and regulations, the Department of Environmental Protection (Department) proposes to issue a permit to discharge, subject to certain limitations set forth in the permit and special conditions. The proposed determinations are tentative. Limitations are provided in the permit as erosion and sedimentation control measures and facilities which restrict the rate and quantity of sediment discharged.

       Where indicated, the EPA, Region III, Regional Administrator has waived the right to review or object to this proposed permit action under the waiver provision of 40 CFR 123.24(d).

       Persons wishing to comment on the proposed permit are invited to submit a statement to the office noted above the application within 30 days from the date of this public notice. Comments reviewed within this 30-day permit will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Department the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held if the responsible office considers the public response significant.

       Following the 30-day comment period, the Water Management Program Manager will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.

    Acknowledgment of Notices of Intent to Remediate submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

       Sections 302--305 of the Land Recycling and Environmental Remediation Standards Act (Act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of any Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. Persons intending to use the background standard, Statewide health standard, the site-specific standard, or who intend to remediate a site as a special industrial area, must file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known suspected contaminants at the site, the proposed remediation measures for the site, and a description of the intended future use of the site. A person who demonstrates attainment of one, or a combination of the cleanup standards, or who receives approval of a special industrial area remediation identified under the Act, will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.

       Under sections 304(n)(l)(ii) and 305(c)(2) of the Act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area of the site. For the sites identified as proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30 days of the date specified. During this comment period the municipality may request that the person identified, as the remediator of the site, develop and implement a public involvement plan. Requests to be involved, and comments, should be directed to the remediator of the site.

       For further information concerning the content of a Notice of Intent to Remediate, please contact the Environmental Cleanup Program Manager in the Department Regional Office under which the notice appears. If information concerning this acknowledgment is required in an alternative form, contact the Community Relations Coordinator at the appropriate Regional Office listed.        The Department of Environmental Protection (Department) has developed an ''integrated'' plan approval, State operating permit and Title V operating permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the public. This approach allows the owner or operator of a facility to complete and submit all the permitting documents relevant to its application one time, affords an opportunity for public input and provides for sequential issuance of the necessary permits.

       The Department has received applications for plan approvals and/or operating permits from the following facilities. Although the sources covered by these applications may be located at a major facility, the sources being installed or modified do not trigger major new source review or prevention of significant deterioration requirements.

       Copies of these applications, subsequently prepared draft permits, review summaries and other support materials are available for review in the Regional Offices identified in this notice. Persons interested in reviewing the application files should contact the appropriate regional office to schedule an appointment.

       Persons wishing to receive a copy of the proposed Plan Approval or Operating Permit must indicate their interest to the Department Regional Office within 30 days of the date of this notice, and must file protests or comments on a proposed Plan Approval or Operating Permit within 30 days of the Department providing a copy of the proposed document to that person or within 30 days of its publicaiton in the Pennsylvania Bulletin, whichever comes first.     Notice of Intent to Issue Title V Operating Permits

       Under 25 Pa. Code § 127.521, the Department of Environmental Protection (Department) intends to issue a Title V Operating Permit to the following facilities. These facilities are major facilities subject to the operating permit requirements under Title V of the Federal Clean Air Act and 25 Pa. Code Chapter 127, Subchapters F and G (relating to operating permit requirements; and Title V operating permits).

       41-00005:  Textron Lycoming, Williamsport Plant (652 Oliver Street, Williamsport, PA 17701) for their aircraft engine manufacturing and rework facility in Williamsport Borough, Lycoming County. The facility's main sources are engine-testing operations, surface-coating operations, degreasing operations and heaters, which have the potential to emit major quantities of Carbon Monoxide (CO) and Volatile Organic Compounds (VOCs). As a result of the potential emissions, the facility is a major stationary source as defined in Title I, Part D of the Clean Air Act Amendments. The facility is therefore subject to the Title V permitting requirements adopted in 25 Pa. Code, Chapter 127, Subchapter G. The facility is also subject to the Maximum Achievable Control Technology (MACT) requirements for their perchlorethylene vapor degreaser and Reasonably Available Control Technology (RACT) requirements for VOC emissions. The facility has the potential to emit particulate matter (PM), nitrogen oxides (NOx), sulfur oxides (SOx) and hazardous air pollutants (HAPs) below the major emission thresholds.

This source is defined as a Title V facility and is therefore subject to the Title V permitting requirements adopted in 25 Pa. Code, Chapter 127, Subchapter G.

       10-285B:  Waste Management Disposal Services of PA, Inc., Northwest Sanitary Landfill (1436 West Sunbury Road, West Sunbury, PA 16061) to downsize the design capacity of the future enclosed flare. The public notice is required for sources required to obtain a Plan Approval at Title V facilities in accordance with 25 Pa. Code § 127.44. The permit will be subject to the following conditions:

       1.  The following conditions are for the utility flare:

       a)  The utility flare shall comply with 40 CFR 60.18 for general control device requirements.

       b)  The utility flare shall be equipped with a continuous pilot ignition source using an auxiliary fuel.

       c)  The utility flare shall be operated with a flame present at all times. The utility flare shall be equipped with an automatic shut-off mechanism designed to immediately stop the flow of gases when a flame-out occurs. During restart or start-up, there shall be sufficient flow of auxiliary fuel to the burners such that unburnt landfill gases are not emitted to the atmosphere.

       2.  The following conditions are for the enclosed flare:

       a)  The enclosed flare shall be designed and operated to either reduce NMOC by 98 weight percent or reduce the outlet NMOC concentration to less than 20 parts per million by volume, dry basis as hexane at 3% oxygen.

       b)  With 30 days of the operator's intent to commence operation, a test procedure and a sketch with dimensions indicating the location of sampling ports and other data to ensure the collection of representative samples shall be submitted to the Department.

       c)  Within 90 days of the operator's intent to commence operation, stack tests shall be performed in accordance with the provisions of Chapter 139 to show that the flare is complying with condition 2a and to determine the emission rate of oxides of nitrogen. Testing shall also be conducted to determine the presence of asbestos in the landfill gas. The stack test shall be performed while the enclosed flare is operated at the maximum rated capacity as stated on the application or the maximum achievable flow rate from the existing gas collection system at the time the performance test is conducted.

       d)  At least 2 weeks prior to the test, the Department shall be informed of the date and time of the test.

       e)  Within 60 days after completion of the test, two copies of the complete test report, including all operating conditions, shall be submitted to the Department for approval.

       f)  Temperature sensing devices shall be installed to monitor exhaust gases, prior to being discharged into the atmosphere. The flare's operating temperature shall not be below 28°C of the average combustion temperature established during the performance test.

       g)  Temperatures shall be recorded whenever the enclosed flare is in operation. The recording charts shall be made available to the Department personnel upon request. These charts shall be maintained for a period of not less than 2 years.

       h)  The enclosed flare must be an enclosed ground type which is shrouded with no visible flame shooting from the flare.

       3.  The facility shall either:

       a)  Install, calibrate and maintain a gas flow rate measuring device that shall record the flow to the control device at least every 15 minutes; or

       b)  Secure the bypass line valve in the closed position with a car-seal or a lock-and-key type of configuration. A visual inspection of the seal or closure mechanism shall be performed at least once every month to ensure that the valve is maintained in the closed position and that the gas flow is not diverted through the bypass line.

       4.  The utility flare will be the primary control device until the enclosed flare is installed. The utility flare shall thereafter only be operated when the enclosed flare is down for maintenance or repairs, or when approved by the Department.

       5.  The facility shall comply with New Source Performance Standards (NSPS) 40 CFR Part 60 Subpart WWW and shall comply with all applicable requirements of this subpart, 40 CFR 60.4 requires submission of copies of all requests, reports, applications, submittals and other communications to both EPA and the Department. The EPA copies shall be forwarded to:  Director, Air, Toxics and Radiation Division, US EPA, Region III, 841 Chestnut Street, Philadelphia, PA 19107.

       The above conditions will satisfy the requirements of 25 Pa. Code § 127.12b (pertaining to plan approval terms and conditions) and will demonstrate the Best Available Technology for the source.

    Notice of Intent to Issue a Plan Approval and Amend a Title V Operating Permit

       In accordance with 25 Pa. Code §§ 127.44(b) and 127.424(b) the Department of Environmental Protection (Department) intends to issue a plan approval to Willamette Industries, Inc., Johnsonburg Mill (100 Center Street, Johnsonburg, PA 15845) in Johnsonburg, Elk County. This plan approval will, in accordance with 25 Pa. Code § 127.450, be incorporated into the Title V operating permit through an administrative amendment at a later date.

       Plan Approval No. 24-315-007A is for defining an alternative SO2 emission limit for the lime kiln when the lime kiln is being used as a back-up control device for the NCG incinerator. This modification will result in an increase in the SO2 emission limit, during the alternative operating scenario, from 9.1 lbs/hour to 66.0 lbs/hour. However, the 39.7 ton/year emission limit defined in Permit No. 24-315-007 shall remain. The Plan Approval and Operating Permit will contain additional recordkeeping and operating restrictions designed to keep the facility operating within all applicable air quality requirements.

    REASONABLY AVAILABLE CONTROL TECHNOLOGY (RACT)

       The Department of Environmental Protection (Department) will conduct a public hearing to accept testimony concerning the Department's decision to approve, with conditions, the revised Reasonably Available Control Technology (RACT) plans by the following companies:

       Ellwood Quality Steels (EQS) (700 Moravia Street, New Castle, PA 16101)

       North American Forgemasters (NAF) (700 Moravia Street, New Castle, PA 16101)

       Ellwood City Forge-New Castle (ECFN) (PO Box 31 Commercial Avenue, Ellwood City, PA 16117).

       To meet the requirements under 25 Pa. Code §§ 129.91--129.95 (RACT), concerning the emissions of oxides of nitrogen (NOx) and volatile organic compounds (VOC) from varous air contamination sources. The final RACT proposals will be submitted to the United States Environmental Protection Agency (EPA) as a revision to Pennsylvania's State Implementation Plan (SIP).

       The proposed SIP revisions do not adopt any new regulations. They incorporate the provisions and requirements contained in RACT approvals for these facilities to comply with current regulations.

       The preliminary RACT determinations, if finally approved, will be incorporated into Plan Approvals and/or Operating Permits for the facilities and will be submitted to the EPA as a revision to SIP.

    APPLICATIONS TO CONDUCT COAL AND NONCOAL ACTIVITIES

       Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21). Mining activity permits issued in response to such applications will also address the applicable permitting requirements of the following statutes:  the Air Pollution Control Act (35 P. S. §§ 4001--4015); the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27); and the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003).

       The following permit applications to conduct mining activities have been received by the Department of Environmental Protection (Department). Where a 401 water quality certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for such certification.

       Where any of the mining activities listed will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. The NPDES permits will contain, at a minimum, technology-based effluent limitations (as described in the Department's regulations--25 Pa. Code §§ 77.522, 87.102, 88.92, 88.187, 88.242, 89.52 and 90.102) for iron, manganese, suspended solids, settleable solids, alkalinity and pH. In addition to the above, more restrictive effluent limitations, restrictions on discharge volume, or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit when necessary for compliance with water quality standards (in accordance with 25 Pa. Code Chapters 93 and 95). Persons or agencies which have requested review of the NPDES permit requirements for a particular mining activity within the above-mentioned public comment period will be provided with a 30-day period to review and submit comments on those requirements.

To remove the existing structure and to construct and maintain a single span bridge having a normal clear span of 92.3 feet and an underclearance of 7.9 feet across Whiteley Creek (WWF) located on T-411 at a point approximately 0.35 mile east of its intersection with SR 2011. The project includes construction and maintenance of cofferdams during construction (Masontown, PA Quadrangle N:  8.9 inches; W:  15.35 inches) in Green Township, Greene County.

       E56-299. Encroachment. Somerset Conservation District, 1590 North Center Avenue, Suite 103, Somerset, PA 15501. To construct and maintain a 200-foot long, 10-foot wide, 6-foot deep open box culvert in Beaverdam Creek (HQ-CWF), to relocate and maintain approximately 1,500 LF of the channel of said stream located between its confluence with Quemahoning Creek and SR 4023. The project includes 1.08 acres of wetland impact. The purpose of the project is to enhance the passive treatment of the acid mine drainage (Boswell, PA Quadrangle N:  5.95 inches; W:  6.05 inches) in the Borough of Jennerstown, Somerset County.

       E20-481A. Encroachment. Conneaut Valley Economic and Industrial Development Authority 103 Main Street, P. O. Box 33, Springboro, PA 16435. To amend Permit No. E20-481 which authorized Conneaut Valley Economic and Industrial Development Authority to dredge and maintain the channel of a tributary to Conneaut Creek (CWF-MF) and to construct and maintain a levee to provide flood protection to the Logan Drive Trailer Court along S. R. 18 approximately 0.7 mile north of S. R. 198 (Conneautville, PA Quadrangle N:  2.8 inches; W:  16.9 inches) in Spring Township and Conneautville Borough, Crawford County. The proposed amendment is to dredge an additional 340 cubic yards of material and maintain the channel of a tributary to Conneaut Creek (CWF-MF) south of the Logan Drive Trailer Court beginning at S. R. 18 and extending upstream approximately 533 feet.

       E24-212. Encroachment. Borough of Johnsonburg, P. O. Box F, Johnsonburg, PA 15845, to maintain the existing Johnsonburg Flood Protection Project constructed by the United States Army Corps of Engineer in and along a total reach of approximately 3,200 feet of West Branch Clarion River extending upstream from its confluence with East Branch Clarion River and approximately 1,632 feet of Silver Creek extending upstream from its confluence with West Branch Clarion River in the Borough of Johnsonburg, Elk County. Extent of activities includes maintenance of all structures as well as periodic removal of accumulated sediments and debris necessary to maintain the capacity of the channel as constructed and shown in the ''As-built'' drawings providing by the United States Army Corps of Engineers dated June 1, 1956 and January 25, 1957.

       E24-213. Encroachment. PA Department of Conservation and Natural Resources, Bureau of Forestry, Rachel Carson State Office Building, 400 Market Street, P. O. To conduct the following activities associated with the replacement of the bridge across Dents Run on Porcupine Road immediately south of Dents Run Road in Elk State Forest (Dents Run, PA Quadrangle N:  20.3 inches; W:  13.8 inches) in Benezette Township, Elk County:

       1.  Remove the existing bridge.

       2.  Remove a gravel bar adjacent to the left abutment measuring approximately 100 feet in length.

       3.  Construct and maintain a rock riprap stream deflector along the right side of the channel approximately 50 feet upstream of the bridge.

       4.  Construct and maintain a prestressed concrete spread box beam bridge having a clear, normal span of 35.8 feet and an underclearance of approximately 8 feet.

       5.  Construct and maintain a stabilized parking area along the left bank upstream of the roadway and adjacent to the intersection of Porcupine Road and Dents Run Road.

       This project includes a permanent impact to a de minimis area (0.012 acre) of wetlands adjoining Dents Run associated with construction of the stream deflector and approach roadway.

       This project also includes a temporary roadway across Dents Run consisting of four 36-inch-diameter plastic pipe culverts and clean rock fill located approximately 50 feet downstream of the bridge and will temporarily impact a total of 0.04 acre of adjoining wetlands with the temporary roadway fill.

    Notice of Proposed Settlement under the Hazardous Sites Cleanup Act

    Ashland Metals and Giordano Waste Materials HSCA Sites

    Butler Township, Schuylkill County

       The Department of Environmental Protection (Department), under the authority of Section 1113 of the Hazardous Sites Cleanup Act (35 P. S. § 6020.1113) (HSCA) has entered into a Consent Order and Agreement with Paul F. and Madeline R. Kerrigan (the Kerrigans). The proposed Consent Order and Agreement concerns settlement of the Department's response costs for the Ashland Metals and the Giordano Waste Materials HSCA sites, both of which are located in Butler Township, Schuylkill County (Sites). The Kerrigans have owned the Ashland Metals Site since June 22, 1970. The Kerrigans owned the Giordano Waste Materials Site from June 22, 1970 until March 24, 1980.

       The Ashland Metals Site, which covers approximately 13 acres in area, is the location of a former lead acid battery recycling facility that operated from 1979 to 1986. Several buildings were on the Ashland Metals Site including the former processing building. Waste piles of chopped battery casings, waste acid tanks, and trailers containing whole and chopped battery casings were present. The primary hazardous substance of concern at the Ashland Metals Site is lead. Lead is found in site soils, waste piles, debris, battery casings, onsite containers, and groundwater. During the period June 1 to September 25, 1998 the Department conducted an interim response at the Ashland Metals Site. The response involved the removal of all surface hazardous waste piles of chopped and whole battery casings, ash, tires, building contents, and debris followed by the placement of a soil cover over the site.

       The Giordano Site, which covers an area of approximately 7 acres, is the location of a former lead acid battery reclamation facility that was operated from 1978 to 1986. Located on the Giordano Site were a building, piles of ash, and piles of battery casings. The primary hazardous substance of concern at the Giordano Site is lead. Lead is found in surface and subsurface soil, buried waste, and groundwater. The Department has undertaken two interim responses at the Giordano Site. The first response took place from September 5, 1989 to April 27, 1990. That interim response involved the transport and disposal of contaminated battery casings and ash to an appropriate disposal facility. The second response took place from June 7 to October 20, 1997. That response involved the removal of additional surface ash and debris piles, scrap metal, battery casings, building debris and contaminated soil.

       The Department has agreed to accept $187,500 in settlement of the Kerrigan's liability for past response costs at the Sites. Additionally, the Kerrigans have agreed to perform future operation and maintenance activities at the Ashland Metals Site.

       This notice is provided under section 1113 of HSCA (35 P. S. § 6020.1113). Section 1113 of HSCA provides that the settlement shall become final upon the filing of the Department's response to significant written comments. The proposed Consent Order and Agreement, which contains the specific terms of the settlement, is available for public review and comment. The proposed Consent Decree can be examined from 8 a.m. to 4 p.m. Monday through Friday at the Department's Northeast Regional Office located at 2 Public Square, Wilkes-Barre, PA 18711, by contacting Woodrow Cole at (570) 826-2511 or through the PA AT&T Relay Service at (800) 654-5984 (TDD). A public comment period on the proposed Consent Decree will extend for 60 days from today's date.     LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

    The following final reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

       Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (Act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the Act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or non-residential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.

       For further information concerning the final report, please contact the Environmental Cleanup Program Manager in the Department Regional Office under which the notice of receipt of a final report appears. To (1)  widen an existing 48.54 wide twin span bridge having two normal clear spans of 56.0 feet each and a minimum underclearance of 10.7 feet × 36.36 feet, and place R-7 rock riprap at the bridge piers and both abutments, across the Beaverdam Branch of the Juniata River (TSF); (2)  construct stormwater detention basin ''C'' in the floodway/floodplain of the Beaverdam Branch of the Juniata River (TSF), on the north side of the river, about 40 feet upstream of SR 1001; (3)  excavate channel bed deposits to a depth of 6 inches above the normal water surface elevation, upstream and downstream through south span of the bridge, for about 165 feet, to create a low flow channel; (4)  excavate gravel deposits to a depth of 6 inches above the normal water surface elevation from along the north bank of the river, about 165 feet upstream, through the north span of the bridge, and about 165 downstream of the bridge and construct an elevated floodplain inside the north span of bridge; (5)  construct a temporary diversion device in the stream channel to redirect stream flows to facilitate construction of the bridge and excavation of the low flow channel and elevated floodplain; (6)  construct a single rock vane on the south bank of the river, about 200 feet upstream of the bridge, to deflect flow from the river banks towards the center of the channel; (7)  construct a double cross rock vane about 50 feet upstream of the bridge to direct flows through the bridge spans and to prevent deposition of bed material under the bridge; (8)  construct a single cross vane, about 50 feet below the bridge, to direct flows towards the center of the channel; (9)  place R-6 size rock riprap on the south bank of the river just below the bridge's wing wall and R-8 size riprap at the outfall of the stormwater detention basin ''C'' on the south bank of the river just upstream of the bridge to protect the bank from scouring; (10)  place a temporary sandbag dike stream diversion to facilitate construction of the rock vanes; (11)  replace a 149.3 foot section of 54-inch diameter corrugated metal pipe, that is part of a 579.4 foot long existing stream enclosure in an unnamed tributary to the Beaverdam Branch of the Juniata River (WWF), with a 48-inch diameter, 149.3 long, reinforced concrete pipe at the Meadows intersection; (12)  waiver a 32.8 foot extension at the inlet end of an existing 100 foot long stream enclosure in an unnamed tributary to the Beaverdam Branch of the Juniata River (WWF) at the Meadows intersection; (13)  waiver the 131.2 foot extension of an existing 12 inch diameter stream enclosure in an unnamed tributary to the Beaverdam Branch of the Juniata River (WWF) at Station 2+428 left on North Juniata Street; (14)  waiver the removal of a 367 foot long, 48-inch diameter reinforced concrete pipe stream enclosure and the construction of replacement 502 foot long, 60-inch diameter reinforced concrete pipe stream enclosure in an unnamed tributary to the Beaverdam Branch of the Juniata River (WWF); (15)  waiver the removal of an existing 48-inch diameter reinforced concrete culvert and a 36-inch diameter reinforced concrete drainage outfall pipe at the Veteran's Home driveway along with the construction of a 48-inch diameter, 85.3 foot long, reinforced concrete replacement culvert with R-8 rock riprap at the outlet in an unnamed tributary to the Beaverdam Branch of the Juniata River (WWF) located about 82 feet south of the existing driveway and to relocate the 36-inch outfall pipe into detention basin B as part of the relocation of the Veteran's Home driveway; (16)  waiver the construction of a 20-inch diameter corrugated metal pipe outfall with R-4 riprap in an unnamed tributary to the Beaverdam Branch of the Juniata River (WWF) about 80 feet downstream of the Veteran's Home driveway all associated with the reconstruction of about 2.0 miles of Plank Road, SR 1001, Section 012 (Hollidaysburg, PA Quadrangle N:  11.3 inches; W:  5.2 inches) in Allegheny and Blair Townships, Blair County. This permit also includes 401 Water Quality Certification.

       E07-331. Encroachment. Norfolk Southern Railway Co., 99 Spring Street, Bldg. Box 142, Atlanta, GA 30303. To construct and maintain (1)  a 22.0 foot wide, 20 foot long, 12-inch thick concrete slab in the bottom of a 135 foot long stone masonry arch bridge across Mill Run (WWF) along with the construction of cofferdams upstream and downstream of the construction area to facilitate control of stream flow during construction and (2)  a 14.0 foot wide, 80 foot long, 12-inch thick concrete slab in the bottom of a stone masonry arch bridge across an unnamed tributary to the Juniata River (WWF) along with the construction of cofferdams upstream and downstream of the construction area to facilitate control of stream flow during construction for the purpose of preventing channel scouring at the bridge abutments located at the railroad crossing at 31st Street in the City of Altoona and at the railroad crossing near Fostoria, Antis Township (Altoona and Bellwood, PA Quadrangle N:  0.3 inch; W:  6.8 inches and N:  21.8 inches; W:  10.0 inches, respectively) in the City of Altoona and Antis Townships, Blair County. This permit was issued under section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

       E31-161. Encroachment. Earl Neiderhiser, PennDot 9-0, 1620 North Juniata Street, Hollidaysburg, PA 16648. To (1)  remove an existing structure and construct and maintain at Station 150+89, SR 0022, Section 011, Structure #1; a pre-stressed concrete box beam bridge having a normal clear span of 31.31 feet and an average underclearance of 5.08 feet across an unnamed tributary to the Frankstown Branch of the Juniata River (a.k.a. Shaffer's Run) (WWF) with R-8 rock riprap placed along the bridge abutments and wingwalls and construct a temporary stream diversion in the stream channel to facilitate construction; (2)  construct and maintain about 60 linear feet of 33.5 cubic yards of R-8 rock riprap revetment along the left stream bank at Station 153+65 through Station 154+25 SR 0022, Section 011 to protect the banks from scouring; (3)  construct and maintain at Station 173+52.50, SR 6022, Section 005 Structure #2; a three span bridge having three spans of 150.0 feet each and an underclearance of about 30.0 feet across an unnamed tributary to the Frankstown Branch of the Juniata River (a.k.a Shaffer's Run) (WWF) with R-8 rock riprap at each bridge pier along with about 80 feet of R-8 rock riprap placed on the north side of the channel to protect the slope from erosion and to construct a cofferdam and temporary causeway consisting of four 60-inch diameter pipes and clean rock fill in the stream channel facilitate piers construction and to provide contractor access to the construction area; (4)  remove an existing box culvert and remove a downstream portion of an existing twin 36-inch reinforced concrete culvert and construct and maintain at Station 188+61.59, SR 6022, Section 005, Structure #3; a 113 foot long reinforced concrete box culvert stream enclosure having a span of 12.0 feet and a rise of 7.0 feet in an unnamed tributary to the Frankstown Branch of the Juniata River (a.k.a. Shaffer's Run) (WWF) along with R-6 riprap rock revetment placed in the stream channel upstream and downstream of the culvert; (5)  remove an existing 56 foot long, 36-inch diameter culvert and to construct and maintain at Station 126+50, SR6022, Section 005, Structure #4; a 54-inch diameter, 400 foot long, reinforced concrete pipe stream enclosure with R-6 rock riprap at the outlet and R-5 rock riprap at the inlet; (6)  waiver the following:  Structure #5; a 24-inch diameter, 100 foot long, reinforced concrete pipe stream enclosure at Station 119+80, S. R. 6022, Section 005; Structure #6; a 42-inch diameter, 208 foot long reinforced concrete pipe stream enclosure at Station 138+70, SR 6022, Section 005; Structure #7; a 30-inch diameter, 232 foot long reinforced concrete pipe stream enclosure at Station 148+00, SR 6022, Section 005; Structure #8; an 18/24-inch diameter, 296 foot long reinforced concrete pipe stream enclosure at Station 170+70, SR 6022, Section 005; remove an existing 24-inch diameter, 200 foot long, reinforced concrete stream enclosure and to construct Structure #9; a 36-inch diameter, 118 foot long reinforced concrete pipe stream enclosure at Station 401+00, SR 0453; to remove a 24-inch diameter, 62 foot long reinforced concrete pipe culvert and to construct Structure #10; a 42-inch diameter, 180 foot long, reinforced concrete pipe stream enclosure at Station 199+45, SR 6022, Section 005; (7)  place fill in 0.01 de minimis acre of wetlands all associated with the relocation of about 2.0 miles of SR 0022 (Spruce Creek, PA Quadrangle N:  13.0 inches; W:  2.0 inches) in Morris Township, Huntingdon County. This permit also includes 401 Water Quality Certification.

       E36-685. Encroachment. WAWA, Inc., 260 W. Baltimore Pike, Wawa, PA 19063. To fill a 1.0 acre farm pond that outlets into a tributary channel to the Conestoga Creek (WWF) for construction of a retail store located at the intersection of Miller Road and SR 72 (Lancaster, PA Quadrangle N:  16.8 inches; W:  14.2 inches) in East Hempfield Township, Lancaster County. The permittee is required to provide 1.16 acres of wetlands to replace the pond. This permit also includes 401 Water Quality Certification.

       E44-100. Encroachment. Norfolk Southern Railway Co., 99 Spring Street, Bldg. Box 142, Atlanta, GA 30303. To construct and maintain a 7.0-foot wide by 100-foot long, 12-inch thick concrete slab in the bottom of an existing 270 foot long stone masonry arch culvert in an unnamed tributary to the Juniata River (HQ-CWF) along with the construction of cofferdams upstream and downstream of the construction area to facilitate control of stream flow during construction for the purpose of mitigating channel scouring at the culvert abutments located on the railroad right of way about 0.7 mile north east of the Borough of Newton Hamilton (New Hamilton, PA Quadrangle N:  4.2 inches; W:  10.75 inches) in Wayne Township, Mifflin County. This permit was issued under section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

       E25-603A. Encroachment. Commodore Perry Yacht Club, P. O. Box 3455, Erie, PA 16508-0455. To amend Permit No. E25-603 which authorized Commodore Perry Yacht Club to clear a navigation channel and conduct periodic maintenance dredging at the existing Commodore Perry Yacht Club at the foot of Poplar Street north of the Bayfront Highway (Erie North, PA Quadrangle N:  1.1 inches; W:  14.1 inches) in the City of Erie, Erie County. This amendment authorizes Commodore Perry Yacht Club to remove two existing solid fill breakwalls and twenty boat slips and to conduct the following activities associated with the expansion of the existing Commodore Perry Yacht Club Marina in Presque Isle Bay, Lake Erie north of the Bayfront Highway approximately 0.8 mile west of State Street (Erie North, PA Quadrangle N:  1.1 inches; W:  14.1 inches) in the City of Erie, Erie County:

       1.  Construct and maintain a 550-foot long by 20-foot wide steel sheet pile solid fill breakwall extending east from the end of existing western breakwall.

       2.  Construct and maintain a 60-foot long by 20-foot wide steel sheet pile solid fill breakwall extending west approximately 75 feet south of the end of the existing eastern breakwall between Commodore Perry Yacht Club and the Cherry Street Marina.

       3.  Excavate existing rock rubble from the lakebed in the area between the existing northern marina breakwall and the proposed breakwall to be used as interior fill for the proposed breakwalls.

       4.  Construct and maintain steel tube floating docks to provide 98 boat slips.
