[30 Pa.B. 5294] APPLICATIONS RECEIVED UNDER THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT [National Pollution Discharge Elimination System Program (NPDES)] DISCHARGE OF CONTROLLED INDUSTRIAL WASTE AND SEWERAGE WASTEWATER (Part I Permits) The following parties have applied for an NPDES permit to discharge controlled wastewater into the surface waters of this Commonwealth. Unless otherwise indicated on the basis of preliminary review and application of lawful standards and regulations the Department of Environmental Protection (Department) proposes to issue a permit to discharge subject to certain effluent limitations and special conditions. These proposed determinations are tentative.
Where indicated the EPA Region III Regional Administrator has waived the right to review or object to this proposed permit action under the waiver provision 40 CFR 123.6E.
Persons wishing to comment on the proposed permit are invited to submit a statement to the office noted above the application within 30 days from the date of this public notice. Comments received within this 30-day comment period, will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held if the responsible office considers the public response significant.
Following the 30-day comment period, the Water Management Program Manager will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.
The application and related documents, proposed effluent limitations and special conditions, comments received and other information are on file and may be inspected and arrangements made for copying at the office indicated above the application.

Proposed NPDES Permit Renewal Actions for Minor Sewage Discharges
The following parties have applied to renew their current NPDES permits to allow the continued discharge of controlled wastewater into the surface waters of this Commonwealth. The Department of Environmental Protection (Department) has made a tentative determination to renew these permits and proposes to issue them, subject to their current permit effluent limitations, and monitoring and reporting requirements, with appropriate and necessary updated requirements to reflect new or changed regulations and other requirements. The updates may include, but will not be limited to, applicable permit conditions and/or requirements addressing combined sewer overflows (CSOs), municipal sewage sludge management and total residual chlorine control (TRC). Any major changes to or deviations from the terms of the existing permit will be documented and published with the final Department actions.
The EPA, Region III, Regional Administrator has waived the right to review or object to these proposed permit actions under the waiver provision 40 CFR 123.6E.
Persons wishing to comment on the proposed permits are invited to submit a statement to the Field Operations indicated as the office responsible, within 30 days from the date of this public notice. Comments received within this 30-day period will be considered in the formulation of the final determinations regarding these applications and proposed permit actions. Comments should include the name, address, telephone number of the writer and a brief statement to inform the Field Office of the basis of the comment and the relevant facts upon which it is based. A public hearing may be held if the Field Office considers the public response significant.
Following the 30-day comment period, the Water Management Program Managers will make a final determination regarding the proposed permit action. LAND RECYCLING AND ENVIRONMENTAL REMEDIATION Under Act 2, 1995 Preamble 1
Acknowledgment of Notices of Intent to Remediate submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).
Sections 302--305 of the Land Recycling and Environmental Remediation Standards Act (Act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of any Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. Persons intending to use the background standard, Statewide health standard, the site-specific standard, or who intend to remediate a site as a special industrial area, must file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known suspected contaminants at the site, the proposed remediation measures for the site, and a description of the intended future use of the site. A person who demonstrates attainment of one, or a combination of the cleanup standards, or who receives approval of a special industrial area remediation identified under the Act, will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.
Under sections 304(n)(l)(ii) and 305(c)(2) of the Act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area of the site. For the sites identified proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30 days of the date specified. During this comment period the municipality may request that the person identified, as the remediator of the site, develop and implement a public involvement plan. Requests to be involved and comments should be directed to the remediator of the site.

A major permit modification the Area III Expansion of this municipal waste landfill located in Taylor and Old Forge Boroughs and Ransom Township, Lackawanna County. The Area III Expansion will provide additional waste disposal area for the existing permitted landfill and will modify existing site facilities to accommodate this expansion. The Area III Expansion will add approximately 147.1 acres to the landfill footprint for a total waste disposal area of approximately 341 acres. This expansion will also add a proposed gross permitted capacity of approximately 55 million cubic yards to the existing landfill, extending the life of this facility up to 23 years. Notice of Plan Approval and Operating Permit Applications
Nonmajor Sources and Modifications
The Department of Environmental Protection (Department) has developed an ''integrated'' plan approval, State operating permit and Title V operating permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the public. This approach allows the owner or operator of a facility to complete and submit all the permitting documents relevant to its application one time, affords an opportunity for public input and provides for sequential issuance of the necessary permits.
The Department has received applications for plan approvals and/or operating permits from the following facilities. Although the sources covered by these applications may be located at a major facility, the sources being installed or modified do not trigger major new source review or prevention of significant deterioration requirements.
Copies of these applications, subsequently prepared draft permits, review summaries and other support materials are available for review in the Regional Offices identified in this notice. Persons interested in reviewing the application files should contact the appropriate regional office to schedule an appointment.
Persons wishing to receive a copy of the proposed Plan Approval or Operating Permit must indicate their interest to the Department Regional Office within 30 days of the date of this notice, and must file protests or comments on a proposed Plan Approval or Operating Permit within 30 days of the Department providing a copy of the proposed document to that person or within 30 days of its publication in the Pennsylvania Bulletin, whichever comes first. Interested persons may also request that a hearing be held concerning the proposed plan approval and operating permit. Any comments or protests filed with Department Regional Offices must include a concise statement of the objections to the issuance of the plan approval or operating permit and relevant facts, which serve as the basis for the objections. If the Department schedules a hearing, a notice will be published in the Pennsylvania Bulletin at least 30 days prior to the date of the hearing.
Final plan approvals and operating permits will contain terms and conditions to ensure that the source is constructed and operating in compliance with applicable requirements in 25 Pa. Code Chapters 121 through 143, the Federal Clean Air Act and regulations adopted under the act.

Notice of Intent to Issue Title V Operating Permits
Under 25 Pa. Code § 127.521, notice is given that the Department of Environmental Protection (Department) intends to issue a Title V Operating Permit to the following facilities. These facilities are major facilities subject to the operating permit requirements under Title V of the Federal Clean Air Act and 25 Pa. Code Chapter 127, Subchapters F and G (relating to operating permit requirements; and Title V operating permits).
Appointments to review copies of the Title V application, proposed permit and other relevant information must be made by contacting Records Management at the regional office telephone number noted. For additional information, contact the regional office noted.
Interested persons may submit written comments, suggestions or objections concerning the proposed Title V permit to the regional office within 30 days of publication of this notice. Written comments submitted to the Department during the 30-day public comment period shall include the name, address and telephone number of the persons submitting the comments, along with the reference number of the proposed permit. The commentator should also include a concise statement of any objections to the permit issuance and the relevant facts upon which the objections are based.
The Department reserves the right to hold a public hearing on the proposed action based upon the information received during the public comment period and will provide notice of any scheduled public hearing at least 30 days in advance of the hearing. The hearing notice will be published in the Pennsylvania Bulletin and a newspaper of general circulation where the facility is located.

41-00016: Plastic Development Co.--Williamsport, Plant (P. O. Box 4007, Williamsport, PA 17701) for a hot tub manufacturing facility in Woodward Township, Lycoming County. The facility's main air contamination sources are gel coating operations, resin spraying operations, spray and touch-up operations, No. 2 fuel oil fired heaters, and PVC cementing operations. This facility has the potential to emit major quantities of hazardous air pollutant (HAP) for Syrene emissions. As a result of the potential emissions, the facility is a major stationary source as defined in Title I, Part D of the Clean Air Act Amendments. The facility is therefore subject to the Title V permitting requirements adopted in 25 Pa. Code Chapter 127, Subchapter G and Maximum Achievable Control Technology (MACT) requirements. The permittee has taken Federally enforceable emissions restriction to limit the facility below the major emission thresholds for Volatile Organic Compounds (VOCs) and HAPs emissions. The facility has the potential to emit sulfur oxides (SOx), Carbon Monoxide (CO), Particulate Matter (PM), and nitrogen oxides (NOx) below the major emission thresholds.

Merck & Co., Inc. Riverside Borough, Northumberland County Merck & Co., Inc. (P. O. Box 600, Danville, PA 17821-0600) has submitted an application (49-313-032H) to the Department of Environmental Protection (Department) under section 127.11 of Chapter 127 of Article III of the Department's Rules and Regulations for approval to install several air cleaning devices for the control of air contaminant emissions from several existing sources (pharmaceutical manufacturing equipment) at its Cherokee facility in Riverside Borough, Northumberland County.
Merck & Co., Inc., is a major facility for which a Title V Operating Permit application (49-00007) has been submitted but for which no Title V Operating Permit has yet been issued.
Information provided by Merck indicates that the air cleaning devices will potentially emit up to 10.9 tons of carbon monoxide per 12 consecutive month period, 1.0 tons of volatile organic compounds per 12 consecutive month period, some of which will also constitute hazardous air pollutants, 8.8 tons of sulfur oxides per 12 consecutive month period, 17.0 tons of nitrogen oxides per 12 consecutive month period, 6.4 tons of particulate matter per 12 consecutive month period, and 6.4 tons of particulate matter less than or equal to 10 microns (PM10) per 12 consecutive month period. A preliminary review of this information by the Department indicates that the air cleaning devices will allow the existing sources to continue to comply with all applicable air quality requirements including the best available technology requirements of 127.1 and 127.12 of Chapter 127 of Article III of the Rules and Regulations of the Department. Based on this finding, the Department proposes to approve the application and issue plan approval for the installation of the proposed air cleaning devices. If this plan approval is issued and if the proposed air cleaning devices and existing sources are subsequently found to be in compliance with all conditions of the plan approval as well as all applicable regulatory requirements, the plan approval will be incorporated into an operating permit via administrative amendment in accordance with Section 127.450 of Chapter 127 of Article III.
In order to ensure compliance with all applicable standards, the Department proposes to place the following conditions in the respective plan approval:
1. The air cleaning devices are to be installed in accordance with the plans submitted with the application (as approved herein).
2. This plan approval is issued for the installation of a T-Thermal #LPV-14M thermal oxidizer equipped with a modified (low nitrogen oxides) burner, a Sub-X water-cooled quench, and a Ceilcote #SPT-54-120 packed bed scrubber, or equivalent, for the control of air contaminant emissions from the following:
a. the sources identified in condition 7 of Operating Permit 49-313-032G.
b. the sources identified in condition 6 of Operating Permit 49-313-035K under the heading ''Summary of process vessels controlled by the fume incinerator''.
3. Under the best available technology provisions of section 127.1 and 127.12 of Chapter 127 of Article III of the Rules and Regulations of the Department of Environmental Protection, during any time that the T-Thermal #LPV-14M oxidizer is being used to control air contaminant emissions from any source identified in condition 2 herein the oxidizer shall maintain a minimum outlet temperature of at least 1,600°F. The only exception to this requirement is if the oxidizer (and Ceilcote packed bed scrubber) are being used to control air contaminant emissions from any of the following sources identified in condition 2b herein: TA-812, TA-1548, TA-1238, TA-1250, HE-1284, TA-1297, ST-1245, or TA-1538 (these sources are also identified in condition 7 of Operating Permit 49-313-035K). During such instances the oxidizer and packed bed scrubber shall comply with the following operating criteria:
a. maintain a minimum oxidizer outlet temperature of at least 1,800°F.
b. maintain a minimum combined volatile organic compound destruction/removal efficiency of 99.9%
c. maintain a minimum combined methylene chloride destruction/removal efficiency of 99.99%
d. maintain a total hydrocarbon concentration in the packed bed scrubbed exhaust of not greater than 50 ppmv
e. maintain a particulate matter emission rate in the packed bed scrubber exhaust of not greater than 0.03 grains per dry standard cubic feet
f. maintain a minimum hydrogen chloride removal efficiency of 99%
4. Under the best available technology provisions of sections 127.1 and 127.12 of Chapter 127 of Article III of the Rules and Regulations of the Department of Environmental Protection, the T-Thermal #LPV-14M oxidizer shall be equipped with a temperature monitor/recorder that shall accurately monitor and record the oxidizer's outlet temperature. The oxidizer shall be equipped with an alarm that will alert the operator should the monitor ever indicate a temperature below the limits established in condition 3 herein. Additionally, the final exhaust stack (downstream of the packed bed scrubber) shall be equipped with oxygen and carbon monoxide monitors that shall accurately monitor the oxygen and carbon monoxide content of the final stack exhaust whenever the oxidizer is in use.
5. Under the best available technology provisions of sections 127.1 and 127.12 of Chapter 127 of Article III of the Rules and Regulations of the Department of Environmental Protection, during any time that the Ceilcote #SPT-54-120 packed bed scrubber, or equivalent, is being used to control air contaminant emissions from any source identified in condition 2 herein the scrubber shall comply with the following operating criteria:
a. utilize a caustic solution as the scrubbing solution
b. maintain a scrubbing solution pH of at least 7
c. maintain a scrubbing solution flow rate of at least 85 gallons per minute
6. Under the best available technology provisions of sections 127.1 and 127.1 of Chapter 127 of Article III of the Rules and Regulations of the Department of Environmental Protection, the Ceilcote #SPT-54-120 packed bed scrubber, or equivalent, shall be equipped with monitors that shall accurately monitor the scrubber's pressure drop and the scrubbing solution's pH and flowrate. The scrubber shall additionally be equipped with an alarm that will alert the operator should the monitors ever indicate a pH or flowrate below the limits established in condition 5 herein.
7. The use of the T-Thermal #LPV-14M oxidizer for the control of air contaminant emissions from the sources identified in condition 2a herein may be temporarily or permanently discontinued at any time at the company's discretion without the necessity of notifying the Department provided the requirements identified in conditions 7 and 10 of Operating Permit 49-313-032G are complied with.
8. The use of the T-Thermal #LPV-14M oxidizer for the control of air contaminant emissions from the sources identified in condition 2b herein may be temporarily or permanently discontinued at any time at the company's discretion without the necessity of notifying the Department provided the requirements identified in conditions 6, 7, 10, and 11 of Operating Permit 49-313-035K are complied with.
9. Within 120 days of startup of the T-Thermal #LPV-14M oxidizer and Ceilcote #SPT-54-120 packed bed scrubber, the company shall perform stack testing upon these units in order to verify the following: volatile organic compound destruction/removal efficiency, methylene chloride destruction/removal efficiency, and hydrogen chloride removal efficiency. The company shall also perform stack testing upon the outlet of the packed bed scrubber for nitrogen oxides and total hydrocarbons. All testing shall be performed using reference method test procedures acceptable to the Department.
10. At least 60 days prior to the performance of any testing required by condition 9 herein a pretest plan shall be submitted to the Department for evaluation. This test plan shall contain the specific testing and analytical procedures to be used in performing the testing.
11. The Department shall be given at least 14 days advance notice of the specific dates and times for the performance of any testing required by condition 9 herein in order that Department personnel can arrange to be present. The Department is under no obligation to accept the results of any testing performed without adequate advance notice having been given to the Department.
12. Within 60 days of completion of any testing required by condition 9 herein, two copies of the test report shall be submitted to the Department. The report shall contain the results of the testing, a description of the testing and analytical procedures actually used, all air cleaning device operating parameters, a copy of all raw test data and a copy of the calculations generated during the data analysis.
13. The air contaminant emissions from the T-Thermal #LPV-14M thermal oxidizer, Sub-X water-cooled quench, and Ceilcote #SPT-54-120 packed bed scrubber, or equivalent, shall never exceed the following limits:
Emission Limit (tons per 12-consecutive Pollutant month period) carbon monoxide 10.9 volatile organic compounds 1.0 sulfur oxides, as SO2 8.8 nitrogen oxides, expressed as NO2 17.0 particulate matter 6.4 PM10 6.4 14. Merck shall maintain comprehensive, accurate records of the following:
a. the outlet temperature of the T-Thermal #LPV-14M thermal oxidizer
b. the dates and times that any of the sources identified in condition 7 of Operating Permit 49-313-035K are operated.
Merck shall maintain these records onsite for at least 5 years and shall make these records available to the Department upon request.
15. Issuance of an operating permit for the aforementioned sources is contingent upon the air cleaning devices being installed and the sources and associated air cleaning devices being maintained and operated, as described in the application and supplemental materials submitted for plan approval, as well as in accordance with all conditions contained herein, and upon satisfactory demonstration that any air contaminants emitted from the sources are in compliance with the requirements specified herein and with the requirements specified in, or established under, any applicable rule or regulation contained in Article III of the Rules and Regulations of the Department of Environmental Protection.
16. The company shall immediately notify the Department of any malfunction of the sources or associated air cleaning devices which results in, or may possibly be resulting in, the emission of air contaminants in excess of the limitations specified in, or established under, any applicable rule or regulation contained in Article III of the Rules and Regulations of the Department or in excess of the limitations specified in any condition contained herein or which otherwise results in, or may possibly be resulting in, noncompliance with the requirements specified in any condition contained herein.
17. This plan approval authorizes temporary operation of the sources covered by this plan approval for a period of up to 180 days from the date of completion of installation of the air cleaning devices for the purpose of equipment shakedown and stack test performance.
In accordance with Section 127.45 of Chapter 127 of Article III of the Rules and Regulations of the Department, the proposed plan approval conditions do one or more of the following:
1. identify the air contamination sources and location
2. establish allowable emission rates
3. establish, monitoring, recordkeeping, testing and reporting requirements
4. ensure proper operation and adequate maintenance
A copy of the application and the Department's analysis are available for public inspection during normal business hours at the address listed below.
Any person wishing to protest the issuance of this plan approval or provide the Department with additional information that he/she believes should be considered prior to the issuance of the plan approval may submit the protest or information to the Department at the address listed. Each written protest or comment should include the following: name, address and telephone number of the person submitting the comments, identification of the proposed Plan Approval 49-313-032H, and a concise statement regarding the relevancy of the information or any objections to the issuance of the plan approval.
A public hearing may be held if the Department, in its discretion, decides that such a hearing is warranted based on the information received. All persons protesting the issuance of plan approval, submitting comments or requesting a hearing will be notified of the decision to hold a hearing by publication in a newspaper of general circulation in Northumberland County, by publication in the Pennsylvania Bulletin, by letter, or by telephone, where the Department determines such notification by telephone is sufficient. All protests, comments and requests must be received by the Department no later than 30 days after publication of this notice.

MINING APPLICATIONS TO CONDUCT COAL AND NONCOAL ACTIVITIES Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21). Mining activity permits issued in response to the applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P. S. §§ 4001--4015); the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27); and the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003).
The following permit applications to conduct mining activities have been received by the Department of Environmental Protection (Department). A copy of the application is available for inspection at the District mining office indicated above each application. Where a 401 water quality certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for such certification.
Written comments or objections, or requests for information conferences on applications, may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code § 77.121--77.123 and 86.31--86.34 (relating to public notices of filing of permit applications, opportunity for comment, and informal conferences).
Where any of the mining activities listed will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. These NPDES permits will contain, at a minimum, technology-based effluent limitations (as described in the Department's regulations--25 Pa. Code §§ 77.522, 87.102, 88.92, 88.187, 88.242, 89.52 and 90.102) for iron, manganese, suspended solids, settleable solids, alkalinity and pH. In addition to the above, more restrictive effluent limitations, restrictions on discharge volume, or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit when necessary for compliance with water quality standards (in accordance with 25 Pa. Code Chapters 93 and 95). Persons or agencies which have requested review of the NPDES permit requirements for a particular mining activity within the above-mentioned public comment period will be provided with a 30-day period to review and submit comments on those requirements.
Written comments or objections should contain the name, address and telephone number of persons submitting comments or objections; application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor; application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

SEWAGE FACILITIES ACT
PLAN APPROVAL
Actions under the Pennsylvania Sewage Facilities Act (35 P. S. §§ 750.1--750.20).
Southeast Regional Office: Sewage Planning Specialist Supervisor, Lee Park, Suite 6010, 555 North Lane, Conshohocken, PA 19428.
The Plan Approval is granted for a revision to the Official Sewage Facilities Plan of Newtown Township, Delaware County. This revision provides for adequate sewage facilities planning to permit the development of a 41,200 square foot office building and 372 age restricted apartment units with community center/recreation facility on 41.3 acres. This project is located on the east side of Route 252, 0.7 mile south of Route 3, in Newtown Township, Delaware County. In addition, 8 homes of Dogwood Place and the two former Benson office buildings will be connected to the proposed treatment facility. This project will generate 85,000 gallons of sewage per day treated at a new wastewater treatment facility with a discharge to Hunters Run. The treatment facility will be owned and operated by Little Washington Wastewater Company, a subsidiary of Philadelphia Suburban Corporation as a Public Utility Commission regulated facility. A Water Quality Part II permit is required for the facility.

Location: The Marion Center Sewage Treatment Plant will be located in East Mahoning Township approximately 700 feet west of the Marion Center Borough municipal boundary on the eastern side of S. R. 0119 and 1,300 feet south of the intersection of S. R. 0119 and S. R. 0403. Discharge from the sewage treatment plant will be to Pine Run in East Mahoning Township, Indiana County.
Project: Approval of an Official Sewage Facilities Plan Update for Marion Center Borough and East Mahoning Township, Indiana County. Project involves construction of a 0.090 mgd sewage treatment facility in East Mahoning Township with collection and conveyance facilities to serve Marion Center Borough and a portion of East Mahoning Township. The treatment facility will discharge to Pine Run.
The Department's review of the sewage facilities update revision has not identified any significant impacts resulting from this proposal.
Location: The Armagh Sewage Treatment Plant will be located approximately 3,000 feet north of the municipality's boundary of Armagh Borough and East Wheatfield Township on the east side of S. R. 0056. This plant location is approximately 3,400 north of the intersection of S. R. 0056 and S. R. 0022. Discharge from the sewage treatment plant will be to Mardis Run in East Wheatfield Township, Indiana County.
Project: Approval of an Official Sewage Facilities Plan Update, Armagh Borough and East Wheatfield Township, Indiana County. Project involves construction of a 0.110 mgd sewage treatment facility in East Wheatfield Township with collection and conveyance facilities to serve Armagh Borough and a portion of East Wheatfield Township. The treatment facility will discharge to Mardis Run.
The Department's review of the sewage facilities update revision has not identified any significant impacts resulting from this proposal.
Location: The Heilwood Sewage Treatment Plant will be located along the south side of T. R. 663 approximately 200 feet west of the intersection of T. R. 633 and S. R. 0403 in Pine Township, Indiana County. The discharge from the sewage treatment plant will be to Yellow Creek in Pine Township, Indiana County.
Project: Approval of an Official Sewage Facilities Plan Update for Pine Township, Indiana County. Project involves construction of a 0.040 mgd sewage treatment facility in Pine Township, Indiana County, with collection and conveyance facilities to serve the Village of Heilwood. The treatment facility will discharge to Yellow Creek.
The Department's review of the sewage facilities update revision has not identified any significant impacts resulting from this proposal.
SAFE DRINKING WATER

The Belmont Water Treatment Plant project includes construction of a chemical feed building and two 20,000 gallon concrete potassium permanganate solution storage tanks. The Queen Lane Water Treatment Plant project includes construction of a chemical feed building and conversion of two existing 40,000 gallon chemical storage tanks to solution storage tanks in the City of Philadelphia, Philadelphia County. This permit authorizes construction of a third traveling bridge filter unit, changes to the piping in the clarifier building and changes and additions to the plant operation monitoring equipment.

The permit was found to be active but their approved facilities are no longer in use, so therefore, the permit has been cancelled.

HAZARDOUS SITES CLEAN-UP Under the Act of October 18, 1988 Settlement Under the Hazardous Sites Cleanup Act Chester County The Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act (HSCA) (35 P. S. §§ 6020.101--6020.1305) and the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) (42 U.S.C.A. §§ 9601--9675), has entered into a settlement relating to the cleanup of the National Precision Casting HSCA Site located at 175 Ravine Road, East Whiteland Township, Chester County, PA (Site). The settlement involves a Consent Order and Agreement between the Department and Ravine Road, L.P. and J. V. D'Ascenzo Construction Company (Settlor), who are potentially responsible parties as current owners of the Site. Settlor did not cause or contribute to the release or threatened release of hazardous substances at the Site.
The Site is a former foundry that was used for casting ferrous and nonferrous molds. Beginning in 1994, the Department conducted an investigation of the Site which revealed contamination of soils at the Site with substances including beryllium, chromium, copper, nickel, lead, zinc, antimony, magnesium, and manganese. In addition, installation and sampling of groundwater monitoring wells at the Site revealed contamination of groundwater with trichloroethylene (TCE). Beginning in November of 1995 through March, 1996, the Department implemented a prompt interim response at the Site. The interim response was carried out at the Site in a manner not inconsistent with the National Contingency Plan (NCP), 40 CFR Part 300, requirements for CERCLA removal actions. As of the date of the Consent Order and Agreement, groundwater contamination remains at the Site at levels above the Maximum Contaminant Level (MCL) for TCE in residential wells. Under the terms of the proposed Consent Order and Agreement, Settlor will make an immediate payment of $9,000 for response costs incurred or to be incurred by the Department in connection with the Site.
This notice is provided under section 1113 of HSCA (35 P. S. § 6020.1113). The Department will provide for a 60-day public comment period on the proposed Consent Order and Agreement from the date of publication of this Notice. The proposed Consent Order and Agreement may be examined from 8 a.m. to 4 p.m. at the Department's office at Lee Park, Suite 6010, 555 North Lane, Conshohocken, PA 19428, by contacting David Minsker at (610) 832-6193 or Paul Rettinger at (610) 832-6300 during normal business hours. Persons may submit written comments to David Minsker at the above address. The Department will provide a response to all significant written comments received during the public comment period, and the proposed Consent Order and Agreement authorizes the Department to withhold or withdraw its consent in the event that the Department determines, based on comments received during the public comment period, that the Consent Order and Agreement is inappropriate, improper or not in the public interest.
Notice of Interim Response Milford Township, Bucks County Mount Milford Site The Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act (35 P. S. §§ 6020.101--6020.1304) (HSCA) has initiated a prompt interim response at the Mount Milford Site in Milford Township, Bucks County, PA. This response has been undertaken under sections 501(a) and 505(b) of HSCA.
The Mount Milford Site is located at 1940 Upper Ridge Road, Milford Township, Bucks County. The Site consists of an abandoned home and a construction-type trailer located behind the home. The trailer was found to contain about 160 five-gallon pails that were labeled ''hazardous'' and ''flammable'' during an inspection of a complaint by the Department's Waste Management Program. The site was subsequently referred to the HSCA program. The HSCA Program with the assistance of the Emergency Response Team, conducted an entry in the trailer in order to obtain samples from the pails. UVIR and Flashpoint sampling analyses were performed on the samples collected during this entry.
The results of the Flashpoint analysis by the Department's Bureau of Labs determined that the contents of the buckets are considered to be hazardous wastes (Ignitibility) as defined by 25 PA Code § 261.21. The trailer in which the pails were located became contaminated by waste leakages from the containers. The total volume for the 160 pails is estimated at 800 gallons.
The Department considered two alternatives: 1) No action, which would allow the pails to remain at their present location, and 2) The removal and proper disposal of the pails. The Department determined that the no action alternative would not be protective of public health or safety or the environment. Deterioration of the pails and the trailer which would have resulted in the release of the pails' contents posed an ignition hazard and would have resulted in soil contamination, potential groundwater contamination and a direct contact threat to persons exposed to the drums' contents.
The Department bulked and secured the pails during September 11--21, 2000. This action was taken prior to the development of the Administrative Record to be protective of human health and safety and the environment.
The Department is providing this notice under sections 505(b) and 506(b) of HSCA, and the publication of this notice starts the Administrative Record public comment period under HSCA. The Administrative Record which contains information about this site and which supports the Department's decision to perform this action at the site is available for public review and comment. The Administrative Record can be examined from 8 a.m. to 4 p.m. at the Department's Southeastern Regional Office located at Lee Park, 555 North Lane, Suite 6010, Conshohocken, PA 19428, by contacting Robert Zang at (610) 832-6152 for an appointment. The Administrative Record will be open for comment from the date of publication of this notice in the Pennsylvania Bulletin and will remain open for 90 days. Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or non-residential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.

The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908) and Chapter 250 Administration of Land Recycling Program.
Provisions of 25 Pa. Code § 250.8 Administration of Land Recycling Program requires the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the Land Recycling and Environmental Remediations Standards Act (Act). Plans and reports required by provisions of the Act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report, and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media, benefits of reuse of the property, and in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. A cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. The report demonstrated attainment of the Statewide health standard and was approved by the Department on August 29, 2000.
Transit America, Inc., City of Philadelphia, Philadelphia County. Robert S. Hyams, Transit America, Inc., One Red Lion Road, Philadelphia, PA 19115, has submitted a supplemental Final Report concerning remediation of site groundwater contaminated with solvents and BTEX and a Final Report concerning remediation of site soils contaminated with PCBs, heavy metals, solvents, BTEX, petroleum hydrocarbons and polycyclic aromatic hydrocarbons. The reports demonstrated attainment of the site-specific standard for groundwater and the Statewide health and site-specific standards for soils and were approved by the Department on September 8, 2000.
Sunoco, Former No. 3 Tank Farm, Bethel Township, Delaware County. James Mulry, Mulry & Cresswell Environmental Inc., 1691 Horseshoe Pike, Suite 1, Glenmoore, PA 19343, has submitted a Final Report concerning remediation of site soil and groundwater contaminated with BTEX, petroleum hydrocarbons and polycyclic aromatic hydrocarbons. The report demonstrated attainment of the Statewide health standard and was approved by the Department on September 11, 2000.
St. Alban's Circle Project, Newtown Township, Delaware County. L. Sherrerd Steele, ePhase Inc., P. O. Box 44, West Chester, PA 19381-0044, has submitted a Final Report concerning remediation of site soil contaminated with polycyclic aromatic hydrocarbons. The Final Report was submitted within 90 days of the date of the release. The report demonstrated attainment of the Statewide health standard and was approved by the Department on September 11, 2000.

Notice of Planning Grant Awards Under Section 901 of the Municipal Waste Planning Recycling and Waste Reduction Act of 1988, Act 101 The Department of Environmental Protection (Department), announces the following grants to counties under section 901 of the Municipal Waste Planning, Recycling and Waste Reduction Act (53 P. S. § 4000.901) (Act 101) and section 208 of the Waste Tire Recycling Act/Small Business and Household Pollution Prevention Act (Act 190 of 1996). This notice is being published to correct the amount of a grant award published in the Pennsylvania Bulletin on September 23, 2000.
Planning grants are awarded to counties for 80% of approved costs for preparing municipal waste management plans as required by Act 101, for carrying out related studies, surveys, investigations, inquiries, research and analysis, including those related to siting, environmental mediation, education programs on pollution prevention and household hazardous waste and providing technical assistance to small businesses for pollution prevention. Grants may be awarded for feasibility studies and project development for municipal waste processing or disposal facilities, except for facilities for the combustion of municipal waste that are not proposed to be operated for the recovery of energy. All grant awards are predicated on the receipt of recycling fees required by sections 701 and 702 of Act 101, and the availability of moneys in the Recycling Fund.
