[Saturday, October 10, 2015]THE CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT APPLICATIONS FOR NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS This notice provides information about persons who have applied for a new, amended or renewed NPDES or WQM permit, a permit waiver for certain stormwater discharges or submitted a Notice of Intent (NOI) for coverage under a General Permit. The applications concern, but are not limited to, discharges regarding industrial, animal or sewage waste, discharges to groundwater, discharges associated with municipal separate storm sewer systems (MS4), stormwater associated with construction activities or concentrated animal feeding operations (CAFO). This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing The Clean Streams Law (35 P. S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

For applications for new NPDES permits and renewal applications with major changes in Section II, as well as applications for MS4 Individual Permits and Individual Stormwater Construction Permits in Sections IV and VI, the Department, based upon preliminary reviews, has made tentative determinations of proposed effluent limitations and other terms and conditions for the permit applications. In accordance with 25 Pa. Code § 92a.32(d), the proposed discharge of stormwater associated with construction activities will be managed in accordance with the requirements of 25 Pa. Code Chapter 102. These determinations are published as proposed actions for comments prior to taking final actions.
Unless indicated otherwise, the United States Environmental Protection Agency (EPA) Region III Administrator has waived the right to review or object to proposed NPDES permit actions under the waiver provision in 40 CFR 123.24(d).
Persons wishing to comment on NPDES applications are invited to submit statements to the contact office noted before the application within 30 days from the date of this public notice. Persons wishing to comment on WQM permit applications are invited to submit statements to the office noted before the application within 15 days from the date of this public notice. Comments received within the respective comment periods will be considered in the final determinations regarding the applications. A comment submittal should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.
The Department will also accept requests for public hearings on applications. A public hearing may be held if the responsible office considers the public response significant. If a hearing is scheduled, a notice of the hearing will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. The Department will postpone its final determination until after a public hearing is held.

Acknowledgment of Notices of Intent to Remediate Submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907)
Sections 302—305 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P. S. §§ 6026.302—6026.305) require the Department to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. A person intending to use the background standard, Statewide health standard, the site-specific standard or intend to remediate a site as a special industrial area shall file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site and a description of the intended future use of the site. A person who demonstrates attainment of one or a combination of cleanup standards or receives approval of a special industrial area remediation identified under the act will be relieved of further liability for the remediation of the site for contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.
Under sections 304(n)(1)(ii) and 305(c)(2) of the act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area of the site. For the following site, proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30 days of the date specified as follows. During this comment period, the municipality may request that the person identified as the remediator of the site develop and implement a public involvement plan. Requests to be involved and comments should be directed to the remediator of the site.

Notice is hereby given in accordance with 25 Pa. This plan approval will be incorporated into the Title V operating permit through an administrative amendment at a later date, and the action will be published as a notice in the Pennsylvania Bulletin.
Plan Approval No. 39-00006C is for the construction of a Cask House dedicated to the casking of malt beverage products. Cask house will age and store Utopias as well as other malt beverage products. The majority of the volatile organic compound (VOC) emissions from the proposed Cask house will be attributed to the evaporative losses through the wooden casks. Minor amounts of VOCs will result from the transfer of the malt beverage between casks during the aging process. The company has conservatively assumed that all casking emissions associated with this project are attributed to the casking of Utopias. No production or packaging increases are associated with the aging and storage of Utopias or other malt beverages at the Cask house. The company's proposal to use good management practices for operation and maintenance of the associated equipment constitutes BAT for malt beverage aging and storage.
The proposed Cask House operations will result in an increase in the VOC potential to emit (PTE) for the facility but will not affect the production or capacity of any other emissions units at the facility.
A review of the information submitted by the company indicates that the proposed project will meet all applicable State and Federal air quality requirements. Based upon these findings, DEP plans to approve the application and issue a permit for the facility.

(5171 Innovation Way, Chambersburg, PA 17201) for the construction of a spray paint system (Source ID 104) equipped with dry panel filters for particulate matter (PM) overspray control at its wood furniture (i.e., cabinets, stairs and railings) manufacturing facility located in Greene Township, Franklin County. The maximum expected increases in facility emissions as a result of the changes proposed are: 6.0 TPY VOC; 0.9 TPY toluene; 0.2 TPY xylene; and 1.1 TPY total HAPs. The facility is a State-Only facility. The Department's review of the information submitted by the applicant indicates that the air contamination source as constructed or modified will comply with all regulatory requirements pertaining to air contamination sources and the emission of air contaminants including the best available technology (BAT) requirement of 25 Pa. Code §§ 127.1 and 127.12, and the surface coating process requirements of 25 Pa. Code § 129.52. Based on these findings, the Department proposes to issue a plan approval for the proposed construction. If, after the project has been implemented, the Department determines that the sources are constructed and operated in compliance with the plan approval conditions and the specifications of the application for plan approval, the requirements established in the plan approval will be incorporated into the facility's State-Only Operating Permit pursuant to the administrative amendment provisions of 25 Pa. 23-00009: The Boeing Company—Philadelphia (PO Box 16858 Philadelphia, PA 19142-0858) for renewal of the Title V Operating Permit for its Ridley Park Pennsylvania Facility, an aerospace fabrication and repair facility located in Ridley Township, Delaware County. The renewal will also include the incorporation of Plan Approvals 23-0009G, 23-0009H and 23-0009F.
Actual emissions from the facility of the following pollutants averaged over the past two years in tons per year were as follows: volatile organic compounds (VOC)—52; nitrogen oxides (NOx) and carbon monoxide (CO)—16; hazardous air pollutants (HAP)—8. Minor amounts of particulate matter (PM) and sulfur oxides (SOx) were also emitted. The proposed renewed Title V Operating Permit does not authorize any increase in air emissions of regulated pollutants above previously approved levels. Upon final approval, the permit will be renewed for a period of five (5) years.

In addition, the requirements of 40 CFR Part 64—Compliance Assurance Monitoring (CAM) for a 73 MMBtu/hr boiler (Source ID 053) are included in the renewal. The Boeing Co. took a restriction of 850 operating hours for each of 4 turbine generators (Source ID 042) to avoid applicability of CAM for the turbine generators.

The latest facility emissions for year 2014 as reported by the company include: CO—24.45 tpy, Lead—0.0 tpy, NOx—25.68 tpy, PM10—0.77 tpy, PM2.5—0.77 tpy, SOx—0.16 tpy, and VOC—4.33 tpy. These sources have the potential to emit major quantities of regulated emissions above the Title V emission thresholds. The proposed Title V Operating Permit contains all applicable requirements including Federal and State regulations. In addition, monitoring, recordkeeping and reporting conditions regarding compliance with all applicable requirements are included.
35-00008: Gentex Corporation Simpson Plant (324 Main Street, PO Box 315, Carbondale, PA 18407-0315) for personal protection equipment and situation awareness products manufacturing in Fell Township, Lackawanna County. This is a renewal of the Title V Operating Permit. The sources consist of five (5) spray paint booths, two (2) spreaders, two (2) boilers, and optical coating lines. The sources are controlled by two (2) regenerative thermal oxidizers (RTO's). The facility has potential emissions of 8.23 tons per year of particulate matter less than 10 microns in diameter and 0.03 ton per year of volatile organic compounds. Some of the equipment in the mineral processing plant is subject to 40 CFR Part 63, Subpart OOO, Standards of Performance for Nonmetallic Mineral Processing Plants. The emission limits, throughput limitations and work practice standards along with testing, monitoring, record keeping and reporting requirements have been included in the operating permit to ensure the facility complies with all applicable Federal and State air quality regulations. 20-00301: Universal Well Services, Incorporated (13549 South Mosiertown Road, Meadville, PA 16335-8317) for a renewal of the Natural Minor Operating Permit to operate a service facility for the mobile equipment used by the company located in Vernon Township, Crawford County. The emitting sources include: 1) Truck Paint Booth, 2) Small Paint Booth and, 3) Emergency Generator. The emergency generator is subject to 40 CFR Part 60, Subpart JJJJ. All applicable conditions of Subpart JJJJ have been included in the permit. In the permit renewal application the facility stated the potential emissions are: VOC: 7.4 Tons per year (TPY), HAP: 1.1 TPY. Emissions from the emergency generator engine are less than 1 TPY for each of the criteria pollutants.

MINING ACTIVITY NPDES DRAFT PERMITS This notice provides information about applications for a new, amended or renewed NPDES permits associated with mining activity (coal or noncoal) permits. The applications concern industrial waste (mining) discharges to surface water and discharges of stormwater associated with mining activities. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P. S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).
The Department of Environmental Protection (Department) has prepared a draft NPDES permit and made a tentative determination to issue the NPDES permit in conjunction with the associated mining activity permit.
Effluent Limits for Coal Mining Activities
For coal mining activities, NPDES permits, when issued, will contain effluent limits that are the more stringent of technology-based (BAT) effluent limitations or Water Quality Based Effluent Limits (WQBEL).
The BAT limits for coal mining activities, as provided in 40 CFR Part 434 and 25 Pa. Code Chapters 87—90 are as follows:

Similarly, modified BAT limits apply to iron, manganese and suspended solids in surface runoff, discharges and drainage resulting from these precipitation events and those of greater magnitude in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.
Exceptions to BAT effluent limits may be applicable in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.
Effluent Limits for Noncoal Mining Activities
The limits for noncoal mining activities as provided in 25 Pa. Code Chapter 77 are pH 6 to 9 and other parameters the Department may require.
Discharges from noncoal mines located in some geologic settings (for example, in the coal fields) may require additional water quality based effluent limits. If additional effluent limits are needed for an NPDES permit associated with a noncoal mining permit, then the permit description specifies the parameters.
In addition to BAT or WQBEL limits, coal and noncoal NPDES permits establish effluent limitations in the form of implemented Best Management Practices (BMPs) identified in the associated Erosion and Sedimentation Plan, the Reclamation Plan and the NPDES permit application. These BMPs restrict the rates and quantities of associated pollutants from being discharged into surface waters in this Commonwealth.
More restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining that may occur are incorporated into an NPDES permit when necessary for compliance with water quality standards and antidegradation requirements (in accordance with 25 Pa. Code Chapters 91—96).
The procedures for determining the final effluent limits, using a mass-balance equation or model, are found in Technical Guidance Document 563-2112-115, Developing National Pollutant Discharge Elimination System (NPDES) Permits for Mining Activities. Other specific factors to be considered include public comments and Total Maximum Daily Load(s). Additional discharge limitations may apply in the event that unexpected discharges occur.
Discharge rates for surface mining activities are precipitation driven. Discharge rates for proposed discharges associated with underground mining are noted in the permit description.
Persons wishing to comment on an NPDES draft permit should submit a written statement to the Department at the address of the district mining office indicated before each draft permit within 30 days of this public notice. Comments received within the comment period will be considered in the final determinations regarding the NPDES permit applications. Comments must include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.
The Department will also accept requests or petitions for a public hearing on NPDES permit applications, as provided in 25 Pa. Code § 92a.82(d). The request or petition for a public hearing shall be filed within 30 days of this public notice and contain the name, address, telephone number and the interest of the party filing the request, and state the reasons why a hearing is warranted. A public hearing may be held if the Department considers the public interest significant. If a hearing is scheduled, a notice of the hearing on the NPDES permit application will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. When a public hearing is held, the Department will consider comments from the public hearing in the final determination on the NPDES permit application.

Newtown, PA 18940Bucks On September 23, 2015, the Southeast Regional office approved an update to Upper Makefield Township (Township), Bucks County's official Plan under the Pennsylvania Sewage Facilities Act, 35 P. S. § 750.1 et seq. (''537 Plan'') (APS ID 879185 AUTH ID 1087694).
The 537 Plan provides for the Township to continue to implement its Sewage Management Program and enforce its on-lot sewage disposal system management ordinance for all areas not currently served by public sewers.
The 537 Plan also provides for the Township to implement the following steps, consistent with the Amended Implementation Schedule, dated July 20, 2015, submitted with the supplemental information for the identified Taylorsville and Dolington needs areas:
1.) Taylorsville and Dolington Areas—The Township will amend its on-lot sewage disposal system (OLDS) management ordinance to delineate special sewage management program districts for the Taylorsville and Dolington areas. A document titled ''Preliminary Draft Potential OLDS Ordinance Amendments'' was provided with the supplemental information. The Taylorsville and Dolington special sewage management districts are shown on Exhibit C of the draft OLDS ordinance amendment.
The amended OLDS ordinance will include supplemental provisions for the Taylorsville and Dolington areas that will include, but not be limited to, the following:
i. Increasing the frequency of septic tank pumping from three to two years.
ii. Requiring pumper/inspector reports to be submitted to the Township within fifteen days of the work being completed, regardless of whether problems are noted by the pumper/inspector. The Township will enter these reports into a database that will be created as part of the OLDS Conditions Monitoring Program to be established for the Taylorsville and Dolington areas.
iii. Requiring property owners to perform annual inspections/assessments of the existing OLDS serving their properties utilizing the Property Owner Inspection Report Form developed by the Township. The Township will enter the results of these reports into the OLDS Conditions Monitoring Program database.
iv. Implementing requirements for replacement of existing plumbing fixtures with low-flow/usage fixtures in conjunction with any plumbing repairs/upgrades performed on any property within the special sewage management program districts.
2.) Taylorsville Area Only—The Township will evaluate the effectiveness of the increased operation and maintenance requirements on the performance of OLDS within the Taylorsville area by performing an updated OLDS survey.
3.) Dolington Area Only—The Township has committed to conduct additional sewage facilities planning to address the long-term sewage disposal needs of the Dolington area. This planning effort will refine/reassess the currently preferred long-term sewage disposal alternative, reassess all currently identified long-term sewage disposal alternatives and identify any new alternatives that may be available based upon changes in current conditions and/or technology that may potentially occur over the short-term planning period.

Allenwood, PA 17810Union Plan Description: The approved plan calls for the Gregg Township Municipal Authority (GTMA) to assume operation and ownership of the Brady Township Southeast Wastewater Treatment Plant, which is to be turned into a pump station after the installation of a force main from that treatment plant to the existing flow equalization tank, which is already owned and operated by GTMA, at Allenwood Federal Penitentiary. This will allow the Lycoming County Resource Management Services (LCRMS) to send 52,500 gallons per day of leachate from the LRCMS Landfill to the GTMA for treatment, once the landfill installs a leachate collection line that ties into the existing Brady Township Southeast Wastewater Treatment Plant collection system, as well as provide more available public sewage capacity for the Timber Run Industrial Park in Brady Township. The total project cost for the selected alternative is estimated to be $2,843,000 and will not impact the user rates of existing customers. The Gregg Township Municipal Authority will ultimately be responsible for an estimated $361,000 of the project costs, which they plan to cover via the use of $260,000 in leftover grant money and cash on hand or a conventional loan. LCRMS will be responsible for a $426,816 tapping fee, they are to cover the costs of construction of their leachate collection line and the force main from the proposed pump station to the flow equalization tank, as well as provide a debt retirement payment to GTMA for the existing Brady Township Southeast Wastewater Treatment Plant. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from the proposal. Any required NPDES Permits or WQM Permits must be obtained in the name of the authority.

The proposed repair is located on Spring Road in Carroll Township, Perry County. The plan is disapproved because the submission failed to comply with public notification requirements in Chapter 71, Section 71.53(d)(6)(i), and the Component 3S form. The submission also failed to include evidence that a certified letter was sent to each owner of property over which the discharge would flow until perennial conditions are met.
LAND RECYCLING AND ENVIRONMENTAL REMEDIATION UNDER ACT 2, 1995

A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

Notice of Planning Grant Awards under section 901 of the Municipal Waste Planning Recycling and
Waste Reduction Act of 1988, Act 101The Department of Environmental Protection (DEP) hereby announces the following grants to counties pursuant to the Pennsylvania Municipal Waste Planning, Recycling and Waste Reduction Act of 1988, Act 101, P. L. 556, Section 901 and Section 208 of the Waste Tire Recycling Act/Small Business and Household Pollution Prevention Act (Act 190 of 1996).
Planning grants are awarded to counties for 80% of approved costs for preparing municipal waste management plans as required by Act 101, for carrying out related studies, surveys, investigations, inquiries, research and analysis, including those related to siting, environmental mediation, education programs on pollution prevention and household hazardous waste and providing technical assistance to small businesses for pollution prevention. Grants may be awarded for feasibility studies and project development for municipal waste processing or disposal facilities, except for facilities for the combustion of municipal waste that are not proposed to be operated for the recovery of energy. All grant awards are predicated on the receipt of recycling fees required by Sections 701 and 702 of Act 101, and the availability of monies in the Recycling Fund.

Water Quality Certification under section 401 of the Federal Clean Water Act for the Tri-County
Bare Steel Replacement ProjectOn February 20, 2015, Columbia Gas Transmission, LLC (Columbia) filed an application with the Federal Energy Regulatory Commission (FERC) in Docket No. CP15-95-000 under Section 7(b) and (c) of the Natural Gas Act (NGA) seeking a Certificate of Public Convenience and Necessity (Certificate) authorizing abandonment, construction,/ and operation of the Tri-County Bare Steel Replacement Project (Project), located in Allegheny, Washington, and Greene Counties, Pennsylvania. The proposed Project would include replacing 34 miles of 20-inch-diameter bare steel piping with coated steel pipeline at the following locations:
• Segment 1: replace approximately 14 miles with 14.9 miles from the Hero Valve to Waynesburg Compressor Station in Greene County.
• Segment 2: replace approximately 8 miles with 10.7 miles from the Redd Farm Station to Sharp Farm Station in Washington County.
• Segment 3: replace approximately 12 miles with 11.9 miles from the Sharp Farm Station in Washington County to the Walker Farm Station in Washington and Allegheny Counties.
The pipeline would also include associated appurtenant facilities including bi-directional pig launcher/receivers, cathodic protection, main line valves, and taps.
The Department, by this notice, proposes to certify that the construction, operation and maintenance of the Project complies with the applicable provisions of sections 301—303, 306 and 307 of the Federal Clean Water Act (33 U.S.C.A. §§ 1311—1313, 1316 and 1317). The Department further proposes to certify that the construction, operation and maintenance of the projects complies with Commonwealth water quality standards and that the construction, operation and maintenance of the projects does not violate applicable Commonwealth water quality standards provided that the construction, operation and maintenance of the projects complies with the conditions proposed for this certification, including the criteria and conditions of the following permits:
1. Discharge Permit—Columbia shall obtain and comply with a PADEP National Pollutant Discharge Elimination System (NPDES) permit for the discharge of water from the hydrostatic testing of the pipeline pursuant to Pennsylvania's Clean Streams Law (35 P. S. §§ 691.1—691.1001) and all applicable implementing regulations (25 Pa. Code Chapter 92a).
2. Erosion and Sediment Control Permit—Columbia shall obtain and comply with PADEP's Chapter 102 Erosion and Sediment Control General Permit for Earth Disturbance Associated with Oil and Gas Exploration, Production, Processing or Treatment issued pursuant to Pennsylvania's Clean Streams Law and Storm Water Management Act (32 P. S. §§ 680.1—680.17) and all applicable implementing regulations (25 Pa. Code Chapter 102).
3. Water Obstruction and Encroachment Permits—Columbia shall obtain and comply with a PADEP Chapter 105 Water Obstruction and Encroachment Permits for the construction, operation and maintenance of all water obstructions and encroachments associated with the project pursuant to Pennsylvania's Clean Streams Law, Dam Safety and Encroachments Act (32 P. S. §§ 673.1—693.27), and Flood Plain Management Act (32 P. S. §§ 679.101—679.601.) and all applicable implementing regulations (25 Pa. Code Chapter 105).
4. Water Quality Monitoring—PADEP retains the right to specify additional studies or monitoring to ensure that the receiving water quality is not adversely impacted by any operational and construction process that may be employed by Columbia.
5. Operation—For each Project under this certification, Columbia shall at all times properly operate and maintain all Project facilities and systems of treatment and control (and related appurtenances) which are installed to achieve compliance with the terms and conditions of this Certification and all required permits. Proper operation and maintenance includes adequate laboratory controls, appropriate quality assurance procedures, and the operation of backup or auxiliary facilities or similar systems installed by Columbia.
6. Inspection—The Projects, including all relevant records, are subject to inspection at reasonable hours and intervals by an authorized representative of PADEP to determine compliance with this Certification, including all required permits required, and Pennsylvania's Water Quality Standards. A copy of this Certification shall be available for inspection by the PADEP during such inspections of the Projects.
7. Transfer of Projects—If Columbia intends to transfer any legal or equitable interest in the Projects which is affected by this Certification, Columbia shall serve a copy of this Certification upon the prospective transferee of the legal and equitable interest at least thirty (30) days prior to the contemplated transfer and shall simultaneously inform the PADEP Regional Office of such intent. Notice to PADEP shall include a transfer agreement signed by the existing and new owner containing a specific date for transfer of Certification responsibility, coverage, and liability between them.
8. Correspondence—All correspondence with and submittals to PADEP concerning this Certification shall be addressed to the Department of Environmental Protection, Southwest Regional Office, Rita Coleman, Waterways and Wetlands Program Manager, 400 Waterfront Drive, Pittsburgh, PA 15222-4745.
9. Reservation of Rights—PADEP may suspend or revoke this Certification if it determines that Columbia has not complied with the terms and conditions of this Certification. PADEP may require additional measures to achieve compliance with applicable law, subject to Columbia's applicable procedural and substantive rights.
10. Other Laws—Nothing in this Certification shall be construed to preclude the institution of any legal action or relieve Columbia from any responsibilities, liabilities, or penalties established pursuant to any applicable Federal or state law or regulation.
11. Severability—The provisions of this Certification are severable and should any provision of this Certification be declared invalid or unenforceable, the remainder of the Certification shall not be affected thereby.
The Environmental Assessment prepared by FERC may be viewed on FERC's website at www.ferc.gov under the Docket No. CP15-95-000.
Prior to final action on the proposed section 401 Water Quality Certification, consideration will be given to any comments, suggestions or objections which are submitted in writing within 30 days of this notice.
