    FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

       The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

       Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with the applicable provisions of sections 301-303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

       Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O.        E08-417. Smithfield Township Supervisors, P. O. Box 27, East Smithfield, PA 18817. Culvert replacement in Smithfield Township, Bradford County, ACOE Baltimore District (Ulster, PA Quadrangle N:  18.3 inches; W:  10.9 inches).

       To: 1) remove the existing arch corrugated steel arch pipe which has a span of 8 feet 2 inches and a rise of 5 feet 9 inches; 2) construct and maintain a 40 foot long, 8 foot 7 inch by 5 foot 11 inch ACMP culvert with a waterway opening of 40 square feet in an unnamed tributary to Sugar Creek on T-623 about 0.8 mile south of the intersection of T-623 with Riggs Road; and 3) place R-5 riprap 24 inches deep 6 feet by 10 feet long by 10 feet wide at the outlet end of the pipe. The project will not impact wetlands while impacting about 60 feet of waterway. Sugar Creek is a WWF stream.

       This permit was issued under Section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

       E12-153. Delvin Cole, 27 Beyers Street, Clearfield, PA 16830. Floodway fill in Lumber Township, Cameron County, ACOE Baltimore District.

       To construct and maintain: 1) 18` by 12` by 10` pressure treated lumber pavilion with a metal roof; 2) 10` by 10` by 10` pressure treated lumber storage shed; 3) A roof over existing 31` by 8` camper; 4) To fill a 30` by 100` long trapezoidal shaped depression with gravel, covered with topsoil and stabilized with grass seed; 5) Install and maintain a 1,000 gallon water storage tank.

       The previously listed facilities are in the 100 year floodplain while about 1/2 of the depression is within the 50` floodway of Driftwood Branch of Sinnemahoning Creek. The project is located 7.5 miles east of Emporium on the west side of SR 120 across from the Country Club (Cameron, PA Quadrangle N:  11.25 inches; W:  8.3 inches) in Lumber Township, Cameron County.

       The project will not impact waterways or wetlands while impacting about 3,500 square feet of earth. Driftwood Branch is a trout stocked fisheries. This permit was issued under Section 105.13(e) ''Small Projects.''

       E49-277. Milton Regional Sewer Authority, P. O. Box 433, Milton, PA 17847. Milton Wastewater Collection Expansion, in West Chillisquaque Township, Northumberland County, ACOE Baltimore District, located at centroid (Northumberland, PA Quadrangle N:  19.55 inches; W:  14.92 inches).

       To construct, operate and maintain one pump station within the floodway and one pump station within the floodplain and approximately 50,000 linear feet of 8-inch force mains and approximately 42,496 linear feet of 8-inch gravity sanitary sewer line within the Susquehanna River watershed (WWF) for the treatment of municipal wastewater. Construction of the sanitary sewer lines will require one stream and three wetland crossings that are as follows:

       All sewer line crossings shall be constructed with a minimum of 3 feet of cover with concrete encasement beneath the waterways. Trench plugs or clay dikes shall be used at every sewer line crossing a waterway or wetland to ensure the hydrology of the streams or wetland is not altered. The project will temporarily impact 1 acre of jurisdictional wetlands and 22 feet of waterway. The project is located within Milton Borough and West Chillisquaque Township, Northumberland County. The project does not propose to permanently impact any jurisdictional wetlands.

       E53-406. Nicolo Tamburo, Two Monaco Avenue, Elmont, NY 11003. Construct, operate and maintain a private bridge across a contributory flood channel associated to First Fork-Sinnemahoning Creek in Wharton Township, Potter County, ACOE Baltimore District (Wharton, PA Quadrangle N:  8.2 inches; W:  3.3 inches).

       To remove an existing structure and construct, operate and maintain a private single span bridge across a contributory flood channel associated to First Fork-Sinnemahoning Creek. The private single span bridge shall be constructed with a minimum clear span of 38-feet, width of 12-feet and underclearance of 6-feet. Bridge construction and maintenance shall be completed during stream low flow. Since First Fork-Sinnemahoning Creek is a stocked trout fishery, no construction or future repair work shall be done in or along the stream channel between March 1 and June 15 without prior written approval of the Fish and Boat Commission. The bridge construction project is located along the western right-of- way of SR 0872 approximately 1.2-miles north of SR 3001 and SR 0872 intersection. This permit does not authorize any temporary or permanent impacts to wetlands that are associated to the flood channel; as such the permittee shall take all precautions necessary to prevent any impact to wetlands. This permit was issued under Section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

       Section 242(c) of the act (53 P.S. §701-242(c)) states that where belt conveyors are installed, main stoppings and regulators shall be so arranged as to reduce the quantity of air traveling in the belt conveyor entry to a minimum for effective ventilation and to provide an intake air split as an escapeway from the face area to the main air current.

       The primary pollutant source for the watershed is abandoned mine workings. This watershed was heavily mined for coal in the 20th century. The effects of this are still present. The TMDL consists of load allocations, which are made to nonpoint sources of pollution.

       The TMDL was developed using Monte Carlo Simulation to determine long-term average concentrations that each stream segment could accept and still meet water quality criteria 99% of the time. Monte Carlo Simulation allows for the expansion of a dataset based on its statistical makeup. Since there was no critical flow condition where criteria were exceeded, the Department used the average flow to express the loading values in the TMDL.

       The TMDL sets allowable loading rates for metals, sediment and acidity at specified points in the watershed. The basis of information used in the establishment of this TMDL is field data collected throughout 2001.
