    APPLICATIONS RECEIVED UNDER THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT

    [National Pollution Discharge Elimination System Program (NPDES)]

    DISCHARGE OF CONTROLLED INDUSTRIAL WASTE AND SEWERAGE WASTEWATER

    (Part I Permits)

       The following parties have applied for an NPDES permit to discharge controlled wastewaters into the surface waters of this Commonwealth. Unless otherwise indicated on the basis of preliminary review and application of lawful standards and regulations, the Department of Environmental Protection (Department) proposes to issue a permit to discharge subject to certain effluent limitations and special conditions. These proposed determinations are tentative.

       Where indicated, the EPA Region III Administrator has waived the right to review or object to this proposed permit action under the waiver provision to 40 CFR 123.6E.

       Persons wishing to comment on the proposed permit are invited to submit a statement to the office noted above the application within 30 days from the date of this public notice. Comments received within this 30-day comment period will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held if the responsible office considers the public response significant.

       Following the 30-day comment period, the Water Management Program Manager will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.

       The application and related documents, proposed effluent limitations and special conditions, comments received and other information are on file and may be inspected and arrangements made for copying at the office indicated above the application.

    Applications for National Pollutant Discharge Elimination System (NPDES) permit to discharge to State waters.

       Outfalls 002 through 005, and 009 through 018 are identified as stormwater outfalls receiving runoff from areas with industrial activity. Monitoring is required for CBOD5, Chemical Oxygen Demand, Oil and Grease, pH, Total Suspended Solids, Total Phosphorus, Total Kjeldahl Nitrogen and Dissolved Iron for Outfalls 002 through 005, and 009 through 018.

       This application is for issuance of an NPDES permit to discharge treated sewage from Garda's Restaurant STP in Manor Township, Armstrong County.

       The following effluent limitations are proposed for discharge to the receiving waters, known as Crooked Creek, which are classified as a warm water fishery with existing and/or potential uses for aquatic life, water supply and recreation. The first downstream potable water supply intake from this facility is the Buffalo Township Municipal Authority-Freeport.

       Outfall 001: new discharge, design flow of 0.0015 mgd.

    Proposed NPDES Permit Renewal Actions for Minor Sewage Discharges

       The following parties have applied to renew their current NPDES permits to allow the continued discharge of controlled wastewater into the surface waters of this Commonwealth. The Department of Environmental Protection (Department) has made a tentative determination to renew these permits and proposes to issue them, subject to their current permit effluent limitations, and monitoring and reporting requirements. The updates may include, but will not be limited to, applicable permit conditions and/or requirements. The updates will not be limited to, applicable permit conditions and/or requirements addressing combined sewer overflows (CSOs), municipal sewage sludge management and total residual chlorine control (TRC). Major changes to or deviations from the terms of the existing permit will be documented and published with the final Department actions.

       The EPA, Region III, Regional Administrator has waived the right to review or object to these proposed permit actions under the waiver provision 40 CFR 123.6E.

       Persons wishing to comment on the proposed permits are invited to submit a statement to the Field Office indicated as the office responsible, within 30 days from the date of this public notice. Comments received within this 30-day period will be considered in the formulation of the final determinations regarding these applications and proposed permit actions. Comments should include the name, address and telephone number of the writer and a brief statement to inform the Field Office of the basis of the comment and the relevant facts upon which it is based. A public hearing may be held if the Field Office considers the public response significant.

       Following the 30-day comment period, the Water Management Program Manager will make a final determination regarding the proposed permit action. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.

       The following permit applications and requests for plan approval have been received by the Department of Environmental Protection (Department). Persons objecting on the grounds of public or private interest to the approval of an application or submitted plan may file a written protest with the Department at the address indicated above each permit application or plan. Each written protest should contain the following: name, address and telephone number; identification of the plan or application to which the protest is addressed and a concise statement in sufficient detail to inform the Department of the exact basis of the protest and the relevant facts upon which it is based. The Department may conduct a fact-finding hearing or an informal conference in response to any given protest.        Phillip Kulp has submitted an application for an NPDES permit for an existing and expanding concentrated animal feeding operation (CAFO) known as Kulp Family Dairy LLC, located on Millerstown Road in North Woodbury Township, Blair County. The CAFO is situated near Clover Creek, which is classified as High Quality Waters-Cold Water Fishes (HQ-CWF). The CAFO is designed to maintain an animal population of 1,988.25 animal equivalent units (AEUs) consisting of 1,410 cows and 135 large heifers and 375 small heifers.

       Manure generated at the older dairy facility is scraped and transported to an existing earthen structure containing an approximate storage capacity of 675,919 gallons and an earthen picket dam storage for solid manure. Manure storage at the new dairy operation consists of a gravity flow facility to two new earthen structures containing approximately 3,174,565 gallons and 2,885,502 gallons. A release or discharge to waters of this Commonwealth under normal operating conditions is not expected. Normal operating conditions are defined as conditions below a 25-year, 24-hour storm event.

       The Department has conducted administrative and technical reviews of the application. Based on the preliminary review and application of lawful standards and regulations including the Final CAFO Strategy, the Department has made a tentative determination to issue an individual NPDES permit for the operation subject to the terms and conditions and monitoring and reporting requirements specified in the draft permit.

       The Environmental Protection Agency (EPA) permit review waiver provision under 40 CFR 123.24(e) does not apply to this NPDES permit.

Comments received within this 30-day period will be considered in formulating the Department's final determination regarding the application.     Acknowledgment of Notices of Intent to Remediate submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

       Sections 302--305 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of any Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. Persons intending to use the background standard, Statewide health standard, the site-specific standard, or who intend to remediate a site as a special industrial area, must file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known suspected contaminants at the site, the proposed remediation measures for the site, and a description of the intended future use of the site. A person who demonstrates attainment of one, or a combination of the cleanup standards, or who receives approval of a special industrial area remediation identified under the act, will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.

       Under sections 304(n)(1)(ii) and 305(c)(2) of the act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area of the site. For the sites identified as proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30 days of the date specified. During this comment period the municipality may request that the person identified, as the remediator of the site, develop and implement a public involvement plan. Requests to be involved, and comments should be directed to the remediator of the site.

       The Department of Environmental Protection (Department) has developed an ''integrated'' plan approval, State operating permit and Title V operating permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the public. This approach allows the owner or operator of a facility to complete and submit all the permitting documents relevant to its application one time, affords an opportunity for public input and provides for sequential issuance of the necessary permits.

       The Department has received applications for plan approvals and/or operating permits from the following facilities. Although the sources covered by these applications may be located at a major facility, the sources being installed or modified do not trigger major new source review or prevention of significant deterioration requirements.

       The following permit applications to conduct mining activities have been received by the Department of Environmental Protection (Department). A copy of the application is available for inspection at the District mining office indicated above each application. Where a 401 water quality certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for such certification.

       Written comments or objections, or requests for informal conferences on applications, may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34 (relating to public notices of filing of permit applications, opportunity for comment, and informal conferences).

       Where any of the mining activities listed will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. The NPDES permits will contain, at a minimum, technology-based effluent limitations (as described in the Department's regulations--25 Pa. Code §§ 77.522, 87.102, 88.92, 88.187, 88.242, 89.52 and 90.102) for iron, manganese, suspended solids, settleable solids, alkalinity and pH. In addition to the above, more restrictive effluent limitations, restrictions on discharge volume, or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit when necessary for compliance with water quality standards (in accordance with 25 Pa. Code Chapters 93 and 95). Persons or agencies which have requested review of the NPDES permit requirements for a particular mining activity within the above-mentioned public comment period will be provided with a 30-day period to review and submit comments on those requirements.

       Written comments or objections should contain the name, address and telephone number of persons submitting comments or objections; application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor; application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

    Bureau of Deep Mine Safety

       The Bureau of Deep Mine Safety has received a request for variance from Quecreek Mining, Inc. The following notification contains a summary of this request. A complete copy of the variance request may be obtained from Allison Gaida by calling (724) 439-7469 or from the BDMS web site at http://www.dep.state.pa.us/dep/deputate/minres/dms/dms.htm.

       The Department is publishing a summary of the request in order to solicit comments from affected parties on the proposed variance request. Comments may be used by the Bureau to assist in its investigation of the variance request. Comments will be accepted for thirty days following the publication of this notice. All comments should be addressed to Richard E. Stickler, Director, Bureau of Deep Mine Safety, Fayette County Health Center, 100 New Salem Road, Room 167, Uniontown, PA 15401.

       Section 702 of the Bituminous Coal Mine Act (act) (52 P. S. §§ 701 and 702) provides a mechanism for operators to obtain variances from specific requirements of the act to accommodate the adoption of new machinery, equipment, tools, supplies, methods or processes.

       Section 242(c) states that where belt conveyors are installed, main stoppings and regulators shall be so arranged as to reduce the quantity of air traveling in the belt conveyor entry to a minimum for effective ventilation and to provide an intake air split as an escapeway from the face area to the main air current.

       Summary of the request: Quecreek Mining, Inc. requests a variance to use a LTPA 98 Point Carbon Monoxide Monitor System and entries in common with the belt conveyor at the Quecreek No. 1 Mine.

    APPLICATIONS RECEIVED UNDER SECTION 401:  FEDERAL WATER POLLUTION CONTROL ACT

    ENCROACHMENTS

       The following permit applications and requests for Environmental Assessment approval and requests for water quality certification have been received by the Department of Environmental Protection (Department). Section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)), requires the State to certify that the involved projects will not violate the applicable provisions of 33 U.S.C.A. §§ 1311--1313, 1316 and 1317 as well as relevant State requirements. Initial requests for 401 certification will be published concurrently with the permit application. Persons objecting to approval of a request for certification under Section 401 or to the issuance of a Dam Safety or Encroachment Permit, or the approval of Environmental Assessments must submit any comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted above the application.

To place and maintain approximately 28,520 cubic yards of fill within a 1.12 acre portion of an existing body of water (WWF) measuring approximately 35 acres in size, which is situated in the floodplain of Martins Creek (WWF). This work is proposed for the reported purpose of reducing drowning liability, creating a picnic area, providing safe access to water and to reclaim land that was quarried. The site is located just north of the intersection of Bristol Pike (S. R. 2055) and Mill Creek Road (Trenton West, PA USGS Quadrangle N:  5.9 inches; W:  7.5 inches) in Falls Township, Bucks County.

       E41-475. Encroachment. Paul E. Heise, District Manager, Department of Transportation, P. O. Box 218, Montoursville, PA 17754-0218. To remove the existing masonry arch bridge with a normal clear span of 18.0 feet, a curb-to-curb width of 16.8 feet, a design underclearance of 6.5 feet, on a 90 degree skew; and to construct and maintain a pre-cast reinforced concrete box culvert 34.0 feet long with a curb-to-curb width of 24.0 feet, depressed 1.0 feet below the streambed with an effective waterway opening of 20.0 feet by 7.0 feet, on a 90 degree skew; and to construct and maintain a temporary rock lined channel or piped around the project site in Murray's Run on SR 1004 approximately 3.5 miles east of the intersection of SR 1004 with Rt. 14. The project will impact 0.03 acre of wetland while impacting approximately 60 feet of waterway. Murray's Run is a High Quality-Cold Water fisheries stream.

This consists of the following:  removal of existing structures, to construct and maintain 1,855 m (3,510 f) stream bank protection; to construct and maintain retaining wall with rock slopes 530 m (1,739 f) to construct and maintain a station platform with retaining walls, rock slopes and catenary poles 175 m (574 f), to construct and maintain pedestrian bridge with a 10.5 m (34.5 f) span and 2.5 m (8.2 f) underclearance, to construct and maintain rail track for 620 m (2,024 f) within the flood plain, to construct and maintain pavement for 10 m (32.8 f) within the flood plain and to construct and maintain a 48 inch outfall to Saw Mill Run (WWF) and to replace the existing structure a Linden Grove structure with a 915 mm (3 f) wide by 3850 mm (8.2 f) underclearance in a tributary to Saw Mill Run (WWF) (the project starts at Pittsburgh East, PA Quadrangle N:  1.1 inches; W:  17.2 inches and the project ends at Bridgeville, PA Quadrangle N:  20.6 inches; W:  3.8 inches) in the City of Pittsburgh, Baldwin Township and Castle Shannon Borough in Allegheny County.

       E56-301. Encroachment. Pennsylvania Turnpike Commission, P. O. Box 67676, Harrisburg, PA 17106-7676. To widen and maintain an existing reinforced concrete deck, slab structure 14.1 feet upstream, increase and maintain the underclearance at 5.4 feet and maintain the normal span at 22.3 feet over an unnamed tributary to Glades Creek (CWF). Also, to place and maintain fill within the 100 year floodplain of the unnamed tributary to Glades Creek (CWF), to permanently place and maintain fill in 0.28 acre of PEM wetlands and temporarily place and maintain fill in 0.02 acre of PEM wetlands. The wetland impacts have been replaced at the Louie-Beach Wetland Bank in Somerset Township, Somerset County.

    Industrial Recycling Services

    Stowe Township, Allegheny County

       The Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act (35 P. S. §§ 6020.101--6020.1304) (HSCA), initiated a prompt interim response at the Industrial Recycling Services Site (Site). This response was undertaken under section 505(b) of HSCA (35 P. S. § 6020.505(b)).

       The Industrial Recycling Services Site is located along McKee Street in Stowe Township, Allegheny County. The Site consisted of an abandoned trailer containing numerous drums of hazardous waste. The trailer was located adjacent to the former Industrial Recycling Services building. The conditions existing at the Industrial Recycling Services site threatened the public health and the environment. There was a direct contact threat to the hazardous substances contained in the trailer. The trailer was not secure and the drums were not sealed. There was a threat of soil/groundwater contamination as the trailer was not sealed and had openings in the roof.

       The Department considered several alternatives at the Site, including:  no action; securing of the site; and disposal/recycling of the waste in the trailer. The Department determined that disposal/recycling of the waste in the trailer was the appropriate course of action. This alternative was selected because it complied with all applicable laws and regulations and was determined to be the most environmentally sound procedure for this site.

       The Department conducted a prompt interim response to remove the waste contained in the trailer from September 5, 2000, to October 26, 2000. All waste in the trailer was removed and properly disposed or recycled. The abandoned trailer was also removed and disposed. A final report for the response is being prepared. The Department, following the public hearing and comment period, will complete a Statement of Decision.

       This notice is being provided under sections 505(b) and 506(b) of HSCA. The administrative record which contains the information that forms the basis and documents the selection of this response action is available for public review and comment.     Proposed Investigation

    Mays/Messner HSCA Site

    North Fayette Township, Allegheny County

       The Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act (35 P. S. §§ 6020.101--6020.1304) (HSCA), is proposing a response action for the Mays/Messner HSCA site (site). The site is located along State Routes 22 and 978 in North Fayette Township in Allegheny County, Pennsylvania. The site comprises approximately 2 acres and was used as a transfer station for residual and hazardous waste materials by Mays Corporation. The area of concern is the property leased by Mays Corporation and adjoining parcels where, the Department suspects, waste materials were illegally buried.

       The Department performed an earlier HSCA interim response at the site to remove and dispose of four roll-off boxes and one tank of waste containing hazardous substances, as well as to remove and dispose of contaminated surface soils. During the interim response, the Department uncovered large pieces of visible white crystalline waste and smaller areas of black granular crystalline waste. Analysis of the waste indicated that it contains naphthalene, benzoic acid and phthalic anhydride. These conditions pose direct contact and ingestion threats to human health and to the environment.

       The purpose of the Department's proposed response at this site is to determine:  the volume and nature of buried waste; the nature and extent of soil contamination; the nature and extent of groundwater contamination; the potential risk posed to residential wells; the risks to human health and the environment; and the need for remedial action.

       The Department has considered the following options:  (1) no action; (2) restricted access; and (3) further investigation.

       Options 1 and 2 would allow illegally buried waste containing hazardous substances to remain onsite and possibly impact groundwater, creating direct contact and ingestion threats to human health and the environment. The contaminants present, as well as the vertical and horizontal extent of impacted media, would remain unknown. Option 2 is not practical since, without determining the area impacted by contamination, an overly conservative approach might be used in applying institutional controls such as fences and deed restrictions. The costs of the Department action might be unduly inflated.

       Option 3, further investigation, would characterize to a fair degree of certainty the nature and vertical and horizontal extent of contamination, as well as any impacts to groundwater that the contamination might be having. Information obtained during the investigation would be used to analyze threats to human health and the environment and to analyze the available remedial alternatives appropriate for the site.

       The Department has selected Option 3 since that option will quantify the threats posed by the site, be as protective as possible of human health and the environment, and provide the information needed to determine the best final solution for the site.

       This notice is being provided under section 506(b) of HSCA. A cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

       The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications, requests for Environmental Assessment approval, and requests for Water Quality Certification under Section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).

       E09-809. Encroachment Permit. Pennsylvania Department of Transportation, 7000 Geerdes Boulevard, King of Prussia, PA 19406. To operate, rehabilitate, and maintain an existing six span masonry arch bridge on Forest Grove Road (S. R. 2097, Section 01S) over Mill Creek (WWF). The proposed rehabilitation will temporarily impact 0.03 acre of wetland for construction equipment access and 32 linear feet of watercourse associated with placement of scour protection. This site is located approximately 300 feet west of the junction of Mill Creek Road, Township Line Road, and Forest Grove Road (Buckingham, PA Quadrangle N:  5.8 inches; W:  2.9 inches) in Buckingham Township, Bucks County.

       E13-124. Encroachment. Chestnut Ridge Railway Company, 900 Delaware Avenue, Palmerton, PA 18071-2008. To modify and maintain the existing railroad bridge across Aquashicola Creek, with work consisting of replacing the superstructure. The bridge has six spans (14.0 feet, 20.0 feet, 20.2 feet, 19.9 feet, 19.6 feet and 19.9 feet) and an average underclearance of approximately 6 feet, and is located approximately 0.6 mile east of the intersection of S. R. 2001 and S. R. 2002 (Palmerton, PA Quadrangle N:  11.2 inches; W:  10.9 inches), in Lower Towamensing Township and Palmerton Borough, Carbon County.

       E39-378. Encroachment. County of Lehigh, 17 South Seventh Street, Allentown, PA 18101-2400. To maintain the existing bridge, having three spans of approximately 47 feet each, with a minimum underclearance of approximately 5.8 feet, across Little Lehigh Creek. The project, known as the Kecks Bridge Repairs, includes the repair of bearing seats, repointing of stone masonry joints and installation of rock scour protection. The project is located along Keystone Avenue, approximately 1.3 miles southeast of S. R. 0309 and S. R. 0029 (Allentown West PA Quadrangle N:  9.6 inches; W:  0.3 inch), in the City of Allentown, Lehigh County.

       E48-292. Encroachment. City of Bethlehem, 10 East Church Street, Bethlehem, PA 18018. To remove deteriorated sections of an existing retaining wall and to construct and maintain a 110-foot long reinforced concrete retaining wall having a maximum height of 7 feet along the western streambank of Monocacy Creek and a 70-foot long reinforced concrete retaining wall having a maximum height of 10 feet along the eastern streambank of Monocacy Creek. The project is located in Johnston Park, between West Broad Street and West Union Boulevard (Allentown East, PA Quadrangle N:  22.4 inches; W:  1.2 inches) in the City of Bethlehem, Lehigh and Northampton Counties.

       E52-165. Encroachment. The Forest Lake Club, R. R. 1, Box 333, Hawley, PA 18428-9718. To remove two existing boathouses and to construct and maintain two boathouses, each having dimensions of 60 feet (along the shoreline) by 25 feet (lakeward) in Wolf Lake. Each boathouse will be supported on a 60-foot by 6-foot concrete pad poured along the shore, and pressure-treated piers set on the lake bottom. The project is located approximately 0.5 mile northwest of the intersection of S. R. 4003 and T-441 (Narrowsburg, NY-PA Quadrangle N:  5.8 inches; W:  13.5 inches), in Lackawaxen Township, Pike County.

       Northcentral Region:  Water Management--Soils and Waterways, F. Alan Sever, Chief, 208 West Third St., Williamsport, PA 17701.

       E14-381. Encroachment. Morse Reese, 1740 Mudlick Rd., Julian, PA 16844. To 1)  remove an existing 36-inch diameter 30-foot long rusted-out CMP, 2)  construct and maintain a 48-inch diameter 60-foot long ADS N-12 polyethylene pipe with the associated 30-foot wide by 1-foot deep emergency overflow swale in the clean approach fill of the left bank, 3)  realign and armor with riprap less than 50 feet of stream channel at the inlet and outlet of the culvert that is in an unnamed tributary to Laurel Run located 0.75 mi up Straw Jack Road from its intersection with Julian Pike (Bear Knob, PA Quadrangle, N:  0.85 inch; W:  14.0 inches) in Houston Township, Centre County. This permit was issued under section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

       E18-301. Encroachment. Pennsylvania Department of Conservation and Natural Resources, Bureau of Facility, Design and Construction, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8451, Harrisburg, PA 17105-8451. To construct a temporary precast concrete barrier and sandbag dikes and to remove the existing steel I-beam timber deck bridge with a clear span of 23.33 feet and a curb to curb width of 11 feet 0 inches and a vertical underclearance of 4.95 feet and to construct and maintain a single span prestressed concrete spread box beam bridge with a total clear span of 32.97 feet on a skew of 90 degrees and an average inlet underclearance of 5.95 feet across Lick Run on Carrier Road approximately 3 miles northwest of the intersection of SR 044 and SR 0644 (Glen Union, PA Quadrangle N:  12.2 inches; W:  2.0 inches) in Gallagher Township, Clinton County.

       E59-405. Encroachment. David L. and Jean L. Brooks, R. R. 7, Box 141, Wellsboro, PA 16901. To construct, operate and maintain a single span private access bridge over Morris Branch. The bridge is authorized to have a span of 39.67 feet and an underclearance of 8 feet. This project is located .15 mile north on SR 287 from Lake Nessmuk (Antrim, PA Quadrangle N:  20.7 inches, W:  6.1 inches) in Wellsboro Borough, Tioga County. This permit was issued under Section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

       E02-1320. Encroachment. USHSS CDC NIOSH Pittsburgh Research Laboratory, P. O. Box 18070, Cochran Mill Road, Pittsburgh, PA 15236-0070. To rehabilitate, operate and maintain the existing Lick Run Bridge having a span of 29.0 feet with a minimum underclearance of 6.0 feet across Lick Run (TSF) located on Main Entry Drive, approximately 200 feet west from the intersection of Main Entry Drive and Cochrans Mill Road (Glassport, PA Quadrangle N:  9.9 inches; W:  13.9 inches) in South Park Township, Allegheny County.        E11-285. Encroachment. Lower Yoder Township, 128 J Street, Johnstown, PA 15906. To remove the existing failed gabion baskets and to construct and maintain cable concrete mats in and along 175 feet of St. Clair Run (CWF) for the purpose of stabilizing the stream banks and invert. The project is located approximately 185 feet downstream of Falcon Drive (Johnstown, PA Quadrangle N:  15.45 inches; W:  12.9 inches) in Lower Yoder Township, Cambria County. This permit was issued under section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.
