    APPLICATIONS RECEIVED UNDER THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT

    [National Pollution Discharge Elimination System Program (NPDES)]

    DISCHARGE OF CONTROLLED INDUSTRIAL WASTE AND SEWERAGE WASTEWATER

    (Part I Permits)

       The following parties have applied for an NPDES permit to discharge controlled wastewaters into the surface waters of this Commonwealth. Unless otherwise indicated, on the basis of preliminary review and application of lawful standards and regulations, the Department of Environmental Protection (Department) proposes to issue a permit to discharge, subject to certain effluent limitations and special conditions. These proposed determinations are tentative.

       Where indicated, the EPA, Region III, Regional Administrator has waived the right to review or object to this proposed permit action under the waiver provision 40 CFR 123.6E.

       Persons wishing to comment on the proposed permit are invited to submit a statement to the office noted above the application within 30 days from the date of this public notice. Comments received within this 30-day period will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held if the responsible office considers the public response significant.

       Following the 30-day comment period, the Program Manager will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.

       The application and related documents, proposed effluent limitations and special conditions, comments received and other information are on file and may be inspected and arrangements made for copying at the office indicated above the application.

    Applications for National Pollutant Discharge Elimination System (NPDES) permit to discharge to State waters.

       PA 0028584, Amendment No. 2.  Sewage, West Goshen Sewer Authority, 520 Veronica Road, West Chester, PA 19380.

       This application is for an amendment of an NPDES permit to discharge treated sewage from West Goshen Sewer Authority sewage treatment plant in West Goshen Township, Chester County. This is an existing discharge to Chester Creek, locally known as Goose Creek.

       The receiving stream is classified for the following uses:  warm water fishery.

       Based on the nutrient-related impairment of the receiving stream, an additional limit for phosphorus is added for the Outfall 001. The proposed additional effluent limits for Outfall 001, based on an average flow of 6.0 mgd effective after completion of the construction of phosphorus removal facilities or December 31, 2000, whichever occurs first, are as follows:

       This application is for renewal of an NPDES permit for an existing discharge of treated industrial waste to Mill Run, in Logan Township, Blair County.

       The receiving stream is classified for high quality cold water fishes, recreation, water supply and aquatic life. For the purpose of evaluating effluent requirements for TDS, NO2-NO3, fluoride and phenolics, the existing downstream potable water supply intake considered during the evaluation was United Water Company located in Dauphin County. The discharge is not expected to impact any potable water supply.

    (Part II Permits)

       The following permit applications and requests for plan approval have been received by the Department of Environmental Protection (Department).

       Persons objecting on the grounds of public or private interest to the approval of an application or submitted plan may file a written protest with the Department at the address indicated above each permit application or plan. Each written protest should contain the name, address and telephone number of the protester, identification of the plan or application to which the protest is addressed and a concise statement or protest in sufficient detail to inform the Department of the exact basis of the protest and the relevant facts upon which it is based. The Department may conduct a fact-finding hearing or an informal conference in response to any given protest. Each protester will be notified in writing of the time and place of any scheduled hearing or conference concerning the plan, action or application to which the protest relates. To insure consideration by the Department prior to final action on permit applications and proposed plans, initial protests and additions or amendments to protests already filed should be filed within 15 calendar days from the date of this issue of the Pennsylvania Bulletin. A copy of each permit application and proposed plan is on file in the office indicated and is open to public inspection.

       A.  0799401.  Sewage, submitted by Northern Blair County Regional Sewer Authority, R. R. 4, Box 236-A, Tyrone, PA 16686 in Snyder Township, Blair County to construct sewers to service the Bald Eagle and Vail areas was received in the Southcentral Region on January 5, 1999.

    Stormwater Individual

       The following parties have applied for an NPDES permit to discharge stormwater from a proposed construction activity into the surface waters of this Commonwealth. Unless otherwise indicated on the basis of preliminary review and application of lawful standards and regulations, the Department of Environmental Protection (Department) proposes to issue a permit to discharge, subject to certain limitations set forth in the permit and special conditions. These proposed determinations are tentative. Limitations are provided in the permit as erosion and sedimentation control measures and facilities which restrict the rate and quantity of sediment discharge.

       Where indicated, the EPA, Region III, Regional Administrator has waived the right to review or object to this proposed permit action under the waiver provision 40 CFR 123.24(d).

    Acknowledgment of Notices of Intent to Remediate submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

       Sections 304 and 305 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of any Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. Persons intending to use a site-specific standard or who intend to remediate a site in a Special Industrial Area must file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known contaminants at the site, the proposed remediation measures for the site and a description of the intended future use of the site. A person who demonstrates attainment of one or a combination of the cleanup standards identified under the act will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted and approved by the Department and shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.

       Under sections 304(n)(1)(ii) and 305(c)(2) of the act, there is a 30-day public and municipal comment period for the sites proposed for remediation using a site-specific cleanup standard, in whole or in part, and for sites determined to be located in Special Industrial Areas. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area by the person conducting remediation.        The Department of Environmental Protection (Department) has developed an ''integrated'' plan approval, State operating permit and Title V operating permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the public. This approach allows the owner or operator of a facility to complete and submit all the permitting documents relevant to its application one time, affords an opportunity for public input and provides for sequential issuance of the necessary permits.

       The Department has received applications for plan approvals and/or operating permits from the following facilities. Although the sources covered by these applications may be located at a major facility, the sources being installed or modified do not trigger major new source review or prevention of significant deterioration requirements.

       Copies of these applications, subsequently prepared draft permits, review summaries and other support materials are available for review in the Regional Offices identified in this notice.     Notice of Proposed Revision to the State Implementation Plan for Oxides of Nitrogen and Volatile Organic Compounds; Public Hearing

       Approval of Reasonably Available Control Technology (RACT) plan for Koppers Industries, Inc. in Clinton Township, Lycoming County.

       The Department of Environmental Protection (Department) has made a preliminary determination to approve a Reasonably Available Control Technology (RACT) plan and an amendment to the State Implementation Plan (SIP) for a cogeneration and railroad crosstie treatment facility owned and operated by Koppers Industries, Inc. in Clinton Township, Lycoming County.

       The proposed SIP revision does not adopt new regulations. It incorporates the provisions and requirements contained in the RACT approval for the facility to comply with current regulations.

       The preliminary RACT determination, if finally approved, will be incorporated into an operating permit for the facility and will be submitted to the United States Environmental Protection Agency (EPA) as a revision to Pennsylvania's State Implementation Plan.

       The following is a summary of the preliminary RACT determination for this facility:

To construct and maintain a structure having five 25-feet wide side by side cells formed by reinforced concrete vertical walls and decking system for a total width of 125 feet, with a minimum 2.5-foot underclearance for enclosure of 390 lineal feet of a tributary to Mill Creek and to impact 0.07 acre of wetlands. The permit also authorized construction of a twin celled reinforced concrete box culvert, each cell having a 10-foot wide span with a 6.5-foot rise across the tributary channel for a new mall access road from Lincoln Highway. The project is for the expansion of parking area and a retail building at the Rockvale Square Outlet Center located along the south side of US Route 30 (Leola, PA Quadrangle N: 4.0 inches; W: 10.5 inches) in East Lampeter Township, Lancaster County.

       E36-665.  Encroachment. East Hempfield Township, Thomas Ernharth, 1700 Nissley Rd., Landisville, PA 17538. To remove sediment deposits from within approximately 200 lineal feet of channel to a tributary to the Little Conestoga Creek beginning approximately 450 feet East of Rohrerstown Road (SR 0741) located behind the Goods Plaza (Lancaster, PA Quadrangle N: 11.0 inches; W: 15 inches) in East Hempfield Township, Lancaster County.

The purpose of the project is to expand parking facilities for two existing commercial businesses located in the same building. The project involves placement of permanent fill in 0.19 acre of PEM wetlands with a 1:1 replacement.

       E14-336.  Encroachment. College Township Water Authority, 1481 East College Ave., State College, PA 16801. Unnamed tributary to Thompson Run CWF. The project is located along the east side of Puddintown Road (SR 3012) approximately 0.5 mile from the intersection of SR 0026 in College Township, Centre County (State College, PA Quadrangle N: 11.5 inches; W: 12 inches). The purpose of the application is to construct and maintain 150 linear feet of 12-inch ductile waterline and associated meter and valve box in EV-PEM/PSS Wetlands. The project will temporarily disturb 0.13 acre of wetlands that shall be fully restored.

       E19-182.  Encroachment. TCBA Farms, R. R. 5, Box 290, Bloomsburg, PA 17815. To modify, operate and maintain an existing public road crossing to enclose an unnamed tributary to Montour Run (a Cold Water Fishery) for the development of a commercial facility. The modification work shall consist of extending an existing 8.0-feet × 5.8-feet × 70.0-feet concrete arch culvert to a length of 150-feet. The extension of the culvert shall be made with a 6.0-feet diameter corrugated metal culvert pipe. The stream enclosure impacts an additional 80.0-feet of waterway and 0.047 acre of wetlands that is located along the western right-of-way of S. R. 0011 approximately 250-feet west of the intersection of S. R. 4004 and T-416 (Danville, PA Quadrangle N: 18.6 inches; W: 0.95 inch) in Montour Township, Columbia County. The project will permanently impact 0.047 acre of wetlands, for which, the applicant will make a contribution to the National Fish and Wildlife Foundation, Pennsylvania Wetland Replacement Fund, in lieu of onsite replacement wetlands.

       E19-187.  Encroachment. PA Department of Transportation, District 3-0, 715 Jordan Street, Montoursville, PA 17754. To replace and maintain an existing 72 inch diameter corrugated metal pipe culvert with a 72 inch diameter corrugated metal pipe culvert in an unnamed tributary to Green Creek located 2 miles south of the intersection of SR-4041 (Rt. 254) and SR-1022 along SR-4041 at the intersection with T-577 (Bloomsburg, PA Quadrangle N: 19.9 inches; W: 5.8 inches) in Orange Township, Columbia County. This project proposes to impact 100 linear feet of an unnamed tributary to Green Creek which is designated a Stocked Trout Stream and does not propose to impact any wetlands.

       E19-188.  Encroachment. Victor Nestico, 430 Maple Street, Kulpmont, PA 17834. To remove approximately 110 feet of 15-inch diameter culvert pipe, to construct and maintain approximately 110 feet of stream channel and to maintain two 95-foot sections of 15-inch diameter culvert pipe in an unnamed tributary to South Branch Roaring Creek at the intersection of T-302 and T-309 (Shamokin, PA Quadrangle N: 15.8 inches; W: 0.6 inch) in Cleveland Township, Columbia County. The project will not impact on wetlands while impacting approximately 110 feet of waterway. The unnamed tributary to South Branch Roaring Creek is a High Quality-Cold Water Fisheries Stream.

       E19-189.  Encroachment. Developers Realty Corporation, P. O. Box 17335, West Hartford, CT 06117. To construct and maintain approximately 318 feet of 24-inch diameter corrugated smooth bore plastic pipe culvert, 250 feet of twin 30-inch diameter corrugated smooth bore plastic pipe culverts in an unnamed tributary to the Susquehanna River. The project is located on the north side of Route 11 approximately 3,500 feet east of the eastern boundary line of the Town of Bloomsburg (Bloomsburg, PA Quadrangle N: 1.6 inches; W: 6.9 inches) in Scott Township, Columbia County. The project will not impact on wetlands while impacting approximately 590 feet of waterway. The unnamed tributary to the Susquehanna River is a Warm Water Fisheries Stream.

Also proposed is the construction and maintenance of rock bank protection on the South Fork of Tenmile Creek (HQ-WWF) from its confluence with West Run downstream for a distance of 154.0 feet and 47.0 feet upstream, two outfall structures, each consisting of a single 18-inch diameter pipe on SR 0021 at stations 14+73.5 and 24+60, a temporary diversion channel having a width of 12.0 feet and a length of 220.0 feet and a temporary roadway crossing consisting of six 42-inch corrugated metal pipes with three pipes located in West Run (HQ-WWF) and three pipes located in the diversion channel. The project is located in Center Township, Greene County.

The approval of coverage for land application of sewage sludge or residential septage under these general permits is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions set forth in the respective general permit. The Department of Environmental Protection approves the following coverages under the specified General Permit.

       The EPA Region III Regional Administrator has waived the right to review or object to this permit action under the waiver provision: 40 CFR 123.24.

    SEWAGE FACILITIES ACT

    PLAN APPROVAL


    Plan approval granted under the Pennsylvania Sewage Facilities Act (35 P. S. §§ 750.1--750.20).

       Regional Office: Water Management Program Manager, Southcentral Region, 909 Elmerton Ave., Harrisburg, PA 17110.

       Location--Conewago Township, Dauphin County, 3279 Old Hershey Rd., Elizabethtown, PA 17022.

       Approved plan provides for public sewer service to Laurel Woods area (0--5 yr.) and Rte. 743 corridor (5--10 yr.) of the Township. Transportation and treatment is through Derry Township Municipal Authority facilities. An onlot disposal system program will be enacted for the remainder of the Township with adoption of an OLDS Management Ordinance and Holding Tank Ordinance. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal. Any required NPDES Permits or WQM Permits must be obtained in the name of the municipality or authority as appropriate.

       Location: City of Williamsport, Lycoming County. An Act 537 update revision for the City of Williamsport has been approved by the Department. The plan calls for construction of an upgrade/expansion of the Williamsport Sanitary Authority's West Treatment Plant. The 7.8 million dollar project will increase the annual average design flow to 3.92 mgd and the maximum monthly average design flow to 5.55 mgd. Discharge of the treated effluent will continue to be to the West Branch Susquehanna River.

       The project will provide treatment capacity for future sewer extensions in several neighboring municipalities. It will also provide capacity for additional commercial and industrial development in the city. The ability of the expanded treatment facility to process peak wet weather flows will allow the city to minimize or eliminate the use of combined sewer overflow discharges of untreated sewage from the combined wastewater collection system which is tributary to this facility.

       The Department's review of the sewage facilities update revision has not identified any significant negative environmental impacts resulting from this proposal.

Treated effluent is to be discharged to the West Branch of Coxes Creek.

    LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

    The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediations Act (35 P. S. §§ 6026.101--6026.908) and Chapter 250 Administration of Land Recycling Program

       Provisions of 25 Pa. Code § 250.8 Administration of Land Recycling Program requires the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the Act 2 (Land Recycling and Environmental Remediation Standards Act) remediation standards. Plans and reports required by provisions of Act 2 for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report, and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media, benefits of reuse of the property, and in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. A cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

       James Meilinger Property, Bethlehem Township, Northampton County. Terrence A. Shannon, President, Synergist, Inc., 10 Enterprise Drive, Carbondale, PA 18407 has submitted a Final Report (on behalf of his client, Nancy Meilinger, 1375 Van Buren Road, Easton, PA 18045) concerning the remediation of site soils found to have been contaminated with lead. The report was submitted to document remediation of the site to meet the Statewide human health standard.

       Edward Hill Property (Creekside Market Place), Lower Saucon Township, Northampton County. Ann Logue, Project Manager, Del Val Soil & Environmental Consultants, Inc., Sky Run II, Suite A1, 4050 Skyron Drive, Doylestown, PA 18901 has submitted a Final Report (on behalf of her client, Edward Hill, 2025 Mountain Hill Lane, Hellertown, PA 18055) concerning the remediation of site soils found to have been contaminated with pesticides and arsenic. The report was submitted to document remediation of the site to meet the Statewide human health standard.

       Kephart Property, Decatur Township, Clearfield County. Patty Kephart, 607 Kate Street, Osceola Mills, PA 16666 has submitted a Final Report concerning the remediation of site soils. The Final Report intended to demonstrate attainment of the Statewide Health Standard and was approved by the Department on December 9, 1998.

       Permit No. PAD064375470.  Advanced Environmental Technical Services, Inc., 1050 West 11th Avenue, Coatesville, PA 19320. This permit for a hazardous waste treatment and storage facility has been revoked, at the permittee's request, because the facility has ceased operations and conducted a clean closure in accordance with the approved closure plan. Facility is located in Valley Township, Chester County. Permit was revoked in the Southeast Regional Office on January 7, 1999.

    Notice of Intent to Issue Title V Operating Permits

       Under 25 Pa. Code § 127.521, notice is given that the Department of Environmental Protection (Department) intends to issue a Title V Operating Permit to the following facilities. These facilities are major facilities subject to the operating permit requirements under Title V of the Federal Clean Air Act and 25 Pa. Code Chapter 127, Subchapters F (relating to operating permit requirements) and G (relating to Title V operating permits).

       Appointments to review copies of the Title V application, proposed permit and other relevant information must be made by contacting Records Management at the regional office telephone number noted. For additional information, contact the regional office noted.

       Interested persons may submit written comments, suggestions or objections concerning the proposed Title V permit to the regional office within 30 days of publication of this notice. Written comments submitted to the Department during the 30-day public comment period shall include the name, address and telephone number of the person(s) submitting the comments, along with the reference number of the proposed permit. The commentator should also include a concise statement of any objections to the permit issuance and the relevant facts upon which the objections are based.

       59-304-008B:  Ward Mfg., Inc. (P. O. Box 9, Blossburg, PA 16912) on December 1, 1998, for operation of two ferrous casting grinders, a Tumblast machine and associated air cleaning device (a fabric collector) and for the operation of an annealing oven at the ACP Division in Lawrence Township, Tioga County.

To reclaim an abandoned quarry/pond, 500 feet long by 100 feet wide by 60 feet deep, by the placement of clean fill, located off U. S. Route 11, just east of Keefer's Lane (Mifflinville, PA Quadrangle N: 5.25 inches; W: 14.37 inches) in South Centre Township, Columbia County.        E41-432.  Encroachment. The Good Will Hunting Club, c/o Jeffrey D. Emerich, 37 Grove, Cressona, PA 17929. To align the channel of Little Pine Creek for the protection of private property from flooding. The realignment work shall consist of removing vegetated gravel deposition to a maximum length of 485-feet, and maximum width of 28-feet and a depth that shall not exceed 6-inches above the water level at the time of the removal. The project is located along the eastern right-of-way of S. R. 0287 approximately 2,000-feet south of the intersection of S. R. 0284 and S. R. 0287 (English Center, PA Quadrangle N: 3.0 inches; W: 3.25 inches) in Pine Township, Lycoming County. To replace and maintain a water intake structure with 50` of 14" diameter perforated steel pipe under the channel floor of Bear Creek located 3.5 miles east on SR 1007 (Big Bear Creek Road) from the intersection of State Route 87 (Picture Rocks, PA Quadrangle N: 21.9 inches; W: 16 inches) in Plunketts Creek Township, Lycoming County. To remove the two existing culverts and to construct and maintain a 16-foot 7-inch by 10-foot 1-inch by 80-foot Aluminum Corrugated Metal Pipe Arch, which will be depressed 12 inches into the streambed, and associated riprap aprons/stream bank protection of Sechlers Run located approximately 200 feet southeast of the S. R. 0011 bridge over Sechlers Run (Danville, PA Quadrangle N: 16.2 inches; W: 8.2 inches) in Cooper Township, Montour County. To construct and maintain a double I beam 20 foot long concrete deck bridge with a minimum underclearance of 4.5 feet in a private driveway across Benny's Run off the north side of Irish Valley Road (S. R. 4026) approximately 2.5 miles west of the intersection of S. R. 4026 with Route 61 (Trevorton, PA Quadrangle N: 11.0 inches; W: 0.0 inch) in Shamokin Township, Northumberland County.        E53-312.  Encroachment. Gospel Tabernacle, Inc., 31 Port Allegany Road, Coudersport, PA 16915-9402. To place fill or excavate in 0.24 acre of a 2.7 acre palustrine emergent wetland for the purpose of constructing an elderly housing complex. To compensate for unavoidable impacts and fulfill the wetland replacement requirement the permittee will participate in the Pennsylvania Wetland Replacement Project. The project site is located directly north of SR 6, approximately 0.1 mile east of the Eulalia Township boundary (Coudersport, PA Quadrangle N: 2.4 inches; W: 6.0 inches) in Coudersport Borough, Potter County.
