Railroad With Hearing [30 Pa.B. 475] Doc. C-00992851. Henry A. Bachik v. Norfolk Southern Corporation, et al. Complainant states the order to operate train with locomotive consist in violation of Chapter 15 33.62 of Subchapter A. Lead locomotive was not equipped with a flush toilet. A unit properly equipped was in his consist and was refused permission to switch engine to make it their lead unit, by local trainmaster R. L. Ferrari. Under threat of insubordination and termination of his job, I dare not refuse to take, so he did so under protest. He states that this was a willful, flagrant, arrogant violation of State law. He would like to stop the procedure of operating units on trains with no lead locomotive not properly equipped with flush toilets.
Doc. C-00992947. Kevin Joseph Musa v. Norfolk Southern Corporation, et al. Complainant states he was ordered to perform service on a non-complying locomotive in the lead position of a train from Harrisburg to Allentown which exceeded the 60 mile limit. It traveled 93 miles, and he was on the engine for 12 hours. Incident took place on October 8th, at approximately 4:55 a.m. He was ordered by Harrisburg terminal train dispatcher to take the train as is, the engine has no toilet whatsoever on it.
An Initial Hearing on this matter will be held Monday, February 28, 2000 at 10 a.m. in an available hearing room, Ground Floor, North Office Building, North Street and Commonwealth Avenue, Harrisburg, PA when and where all persons in interest may appear and be heard, if they so desire.
