    FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

       The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

       Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

       Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users should contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period.        To construct and maintain a single span prestressed concrete spread box beam bridge with a clear span of 55 feet and an underclearance of approximately 4.83 feet and an overflow pipe with a length of 40 feet and a diameter of 24 inches to replace the existing structures, which span Crum Creek (WWF). The work will include the following activities:

       1.  To impact approximately 50 feet of Crum Creek (WWF) for the construction of the bridge abutments, wingwalls and other appurtenant structures.

       2.  To place fill and impact 0.017 acre of wetland ''A'' (PEM) for the widening of Crum Creek Road. The amount of wetland impact is considered a de minimis impact and wetland mitigation is not required.

       3.  To construct and maintain a stormwater outfall within the floodway of Crum Creek (WWF) to pair with an additional stormwater inlet for runoff deriving from super-elevation extension associated with modification to the Crum Creek and Waters Edge Roads.

       4.  To perform various grading activities to accommodate the provision of the new abutment and extension of the new bridge span.

       5.  To install a temporary cofferdam to facilitate the free flow of the stream during construction.

       6.  To place approximately 25 cubic yards of rip rap at the base of the abutments to protect against scour.

       The project will temporarily impact 200 feet of stream and permanently impact approximately 50 feet of stream and 0.017 acre of wetland. The project site is located along Crum Creek Road (T-421) approximately 0.4 mile north of the intersection of Crum Creek and Waters Edge Roads with Maple Township on the east side and Upper Providence Township on the west side, Delaware County (Media, PA, Quadrangle N:  12.17 inches; W:  0.03 inch).

       The issuance of this permit also constitutes approval of a Water Quality Certification under section 401(a) of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).

       To maintain 2000 cubic yards of fill and 0.5-acre of grading in a pond associated with an UNT to Back Creek (TSF) and maintain 155-feet of grading in an intermittent UNT to Back Creek (TSF). The project is located off of Center Drive, on Cherry Lane Drive (Chambersburg, PA Quadrangle N:  9.2 inches; W:  10.4 inches; Latitude: 39° 55` 32"; Longitude: 77° 41` 58") in Hamilton Township, Franklin County.

       To construct and maintain 50-feet of 6-inch PVC dry hydrant in Spring Creek (HQ-CWF) located in the parking area behind the Match Factory Building in Bellefonte Borough, Centre County. This permit was issued under Section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

       E19-255. Doug Mills, 514 W. Summit Ave, Wilmington, DE, 19804. Mills Cabin Raising, in Orange Township, Columbia County, ACOE Baltimore District (Bloomsburg, PA Quadrangle Latitude 41-03-31, Longitude 76-25-51).

       To raise the existing cabin from its current elevation to an elevation 8 feet 6 inches above the existing ground in the floodway of Fishing Creek. The new first floor elevation of the cabin will be 552 ft. This permit does not authorize any additional fill to be placed in the floodway nor does it authorize the area beneath the cabin to be enclosed. This project is located at the Fishing Creek Campground and is the first cabin on the left after traveling left at the ''Y'' in the Fishing Creek Campground Road. This permit was issued under Section 105.13(e) ''Small Projects.''

       E47-084. Sunny Brook Park Association, P. O. Box 124, Danville, PA 17821. Pedestrian Bridge in Valley Township, Montour County, ACOE Baltimore District (Danville, PA Quadrangle N:  20.32 inches; W:  17.21 inches).

       To construct, operate and maintain a new footbridge structure located on Mahoning Creek, which is designated as WWF. The structure will have a normal span of 62.25 feet and a width of 7 feet 11 inches. The permit also authorizes 126 cubic yards of fill placed within the floodway for the proposed parking area. This project is located east on SR 642 from the SR 54 intersection just over the Mahoning Creek Crossing. This permit was issued under Section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

       Northwest Region: Watershed Management Program Manager, 230 Chestnut Street, Meadville, PA 16335-3481.

       E42-325, Universal Well Services, Inc., 201 Arch Street, Meadville, PA 16335. Bradford Facility, in Bradford Township, McKean County, ACOE Pittsburgh District (Bradford, PA Quadrangle N:  41°, 56`, 05"; W:  78°, 38`, 36" inches).

       To conduct the following activities associated with construction of a base of operations southeast of the intersection of High Street Extension and Rutherford Run Road:

       1.  Fill a total of 0.48 acre of wetlands (0.31 acre PEM and 0.17 acre PSS).

       2.  Construct and maintain a 100-foot long, 142-inch wide by 91-inch high corrugated metal pipe stream enclosure in Rutherford Run.

       3.  To realign a total of approximately 400 feet of the channel of Rutherford Run, including the 100-foot long enclosure.

       4.  To place fill within the floodway of Rutherford Run along the approximate 400-foot reach extending upstream from High Street Extension, including the 100-foot long enclosure.

       Project proposes the creation of 0.75 acre of replacement wetland on property located along the east bank of Tunungwant Creek north of Owens Way.

       To construct and maintain an abandoned mine discharge (AMD) passive treatment system proposed in and along a tributary to Crystal Run (CWF). The purpose of the project is to treat and reduce AMD loadings discharging from the Neumeister Mine Outfall to restore the water quality of Crystal Run. The project is located east of SR 0081, approximately 2 miles south of Exit 116 (Minersville, PA Quadrangle N:  12.8 inches; W:  15.3 inches).

       Description: The Pennsylvania Infrastructure Investment Authority, which administers the Commonwealth's State Revolving Fund, is intended to be the funding source for this project. The Borough proposes to separate the combined sewers on Mill, Main and Green Streets. The Department's review of the project and the information received has not identified any significant, adverse environmental impact resulting from this proposal. The proposed TMDL for the Dooley Run Watershed sets allowable loading rates for metals and acidity at specified points in the watershed. Field data collected over the past 2 years was used to establish the proposed TMDL for the Dooley Run Watershed. The data and all supporting information used to develop the proposed TMDL are available from the Department.

       The proposed TMDL for the Freeman Run Watershed was established in accordance with the requirements of the Clean Water Act, Section 303(d). One stream segment in the Freeman Run Watershed has been identified as impaired on the 1996 Pennsylvania Section 303(d) list due to high concentrations of metals.        The primary pollutant source for the watershed is abandoned mine workings. This watershed was mined for coal in the 1900s. The effects of this are still present.

       The proposed TMDL was developed using Monte Carlo Simulation to determine long-term average concentrations that each stream segment could accept and still meet water quality criteria 99% of the time. Monte Carlo Simulation allows for the expansion of a data set based on its statistical makeup. Since there was no critical flow condition where criteria were exceeded, the Department used the average flow to express the loading values in the proposed TMDL. The proposed TMDL for the Freeman Run Watershed sets allowable loading rates for metals and acidity at specified points in the watershed. Field data collected over the past 2 years was used to establish the proposed TMDL for the Freeman Run Watershed. The data and all supporting information used to develop the proposed TMDL are available from the Department.

The meeting will begin at 10:30 a.m. on February 8, 2007, and will be held at the Department's Moshannon District Mining Office along Enterprise Drive in the new business park east of Philipsburg, PA.
